Requested Action
MOTION TO AWARD open-end contract to low responsive, responsible bidder, The Tools Man, Inc., a certified Small Business Enterprise, for Street Light Luminaires, Bid No. OPN2115816B1, for the Traffic Engineering Division, in the annual estimated amount of $289,083, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $867,249. The initial contract period shall begin on the date of award and will terminate one year from that date.

In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/TRAFFIC ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) designated this project as reserved for certified Small Business Enterprises (SBE). The OESBD has reviewed the bids and determined that The Tools Man, Inc. meets the eligibility criteria of the SBE Reserve Program (Exhibit 2).

The purpose of this contract is to provide street light luminaires for the Traffic Engineering Division and various other Broward County agencies that may have a need of these products.

The Director of Purchasing has determined the apparent low bidders, World Electric Supply.com and Graybar Electric Company, Inc., to be non-responsive; the bidders were non-compliant with the SBE requirements of the bid (Exhibit 2).

The initial bid submitted by The Tools Man, Inc. was $304,300; the vendor offered a voluntary price reduction of 5% on all items, resulting in an overall savings of $15,217 and a revised estimated initial term amount of $289,083. The Broward County Procurement Code, Section 21.30.f.2(c), allows for acceptance of a voluntary reduction after bid opening, if such reduction does not result in the modification or deletion of any condition of the bid.

The Traffic Engineering Division has reviewed the bid submitted by The Tools Man, Inc. and concurs with the recommendation for award (Exhibit 3). Fourteen vendor performance evaluations have been completed for The Tools Man, Inc.; they have an overall rating of 4.14 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

The Purchasing Division has researched the prices submitted by the recommended bidder, The Tools Man, Inc., and has determined that the prices submitted are fair and reasonable in comparison to the previous Broward County contract and to the bids of other SBE respondents (Exhibit 4).

The amounts referenced in this agenda item have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

The bid validity for this project expired on July 28, 2018. The Tools Man, Inc. has agreed to extend its bid validity through October 31, 2018 for Bid No. OPN2115816B1.

There was no protest or appeal filed regarding this procurement.

The bid posted on March 21, 2018 and opened on March 28, 2018; six bids were received with no declinations (Exhibit 1).
