Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

Broward County is extending the fiber optic traffic signal communications network along Broward Boulevard from University Drive to Flamingo Road in the City of Plantation. This construction project requires crossing the Old Plantation Water Control District's Canal No. C2 and Canal No. C3 along the north side of Broward Boulevard. The C2 crossing will consist of a bridge-mounted conduit and the C3 crossing will be an underground directional bore crossing. The District is agreeable to these canal crossings and requires the use of a permit, rather than a typical revocable license agreement, to provide Broward County with the necessary access.

Approval of the permit by the Board of County Commissioners will allow Broward County to construct, maintain and repair improvements within the District's canals. The permit is a non-exclusive, revocable permit. It includes limitation statements, insurance requirements, and an indemnification provision which are typically included in a revocable license agreement rather than in a permit. The District requires these permit conditions for projects within its canals.

The Old Plantation Water Control District approved this permit in mid-2017. However, it could not be brought to the Board of County Commissioners for approval until the U.S. Army Corps of Engineers (ACOE) issued its permit for the project. ACOE required an extended review and approval period due to the significant backlog in its internal plan review process. The ACOE permit for this project was issued on July 30, 2018 and this permit with the Old Plantation Water Control District is now ready for the Board's consideration and approval.

The permit has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
