Requested Action
A. MOTION TO APPROVE Memorandum of Agreement between the Florida Alcohol and Drug Abuse Association (FADAA) and Broward County, for the provision of education, screening and administration of extended-release injectable naltrexone (VIVITROL) to treat eligible individuals participating in Broward Addiction Recovery Division's (BARC's) Medication Assisted Treatment (MAT) program, in the estimated annual amount of $138,464 reimbursement to the County, effective October 1, 2018 through June 30, 2019 (with one-year renewal terms upon mutual written agreement); authorizing the Mayor to execute same; authorizing the County Administrator to execute renewals and amendments to the Agreement that include funding increases not to exceed a total amount of $207,696, subject to approval of the same by the Office of the County Attorney; authorizing the County Administrator to take all administrative and budgetary actions related to the Agreement.

B. MOTION TO ADOPT budget Resolution No. 2018-423 of the Board of County Commissioners of Broward County, Florida (Board), providing revenue within the Substance Abuse Service Grant Fund in the amount of $138,464 for the provision of VIVITROL treatment for eligible individuals participating in BARC’s MAT program. This amount is an estimated annual reimbursement.

Why Action is Necessary
Agreements with external agencies require Board approval. Section 129.06 (2)(d), Florida Statutes, requires Board approval to recognize revenue.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE BROWARD ADDICTION RECOVERY DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

This item supports the Board's Value of "[A]pproaching human services collaboratively and compassionately, with special emphasis on the most vulnerable," and the Goal to "[D]eliver evidence-based services to the public, and connect customers and their family members to sustainable support, with special emphasis on financial supports." Funding will enable the county to provide individuals struggling with addiction additional medication within its evidence-based MAT program.

In 2017, the Centers for Disease Control and Prevention declared the national opioid crisis to be an epidemic and the Florida Governor officially declared the opioid epidemic to be a public health emergency in Florida.

The Agreement with FADAA provides pass-through grant funding received from the State of Florida Department of Children and Families (DCF) to provide VIVITROL and treatment services to an anticipated 23 eligible individuals medically qualified to participate in BARC’s MAT program. Eligible individuals are not required to have involvement in criminal  justice system. BARC will be reimbursed for Vivitrol medication and MAT services according to unit rates established in the Agreement. It is noted that no cure provision is provided in the event that FADAA terminates the Agreement, however, FADAA is obligated to pay for all services rendered and unpaid at the time of termination.

A similar Agreement was previously approved by the Board on December 12, 2017 (Item No. 14) for a one-year term with an automatic one-year renewal term. FADAA provided the County notice on June 12, 2018 of early termination to align the Agreement with the State's Fiscal Year and to revise some terms and conditions in a new document.

The new Agreement will be effective from October 1, 2018 through June 30, 2019, and will renew annually, effective July 1, 2019 upon mutual written agreement for as long as funding through DCF is available. FADAA has initially allocated to Broward County $138,464 for the provision of Vivitrol and treatment services. FADAA performs a quarterly utilization review and adjusts provider funding according to usage. BARC anticipates total annual funding up to $207,696. Funding allocation is dependent upon numerous factors such as availability of funds from DCF, the number of other agencies funded by FADAA, and the rate of usage by funded agencies. These factors are variable and will impact the funding available under this Agreement. FADAA provides for adjustments as necessary throughout the year.

The Agreement is in FADAA’s format and it will sign last, following Board approval. The Agreement provides that, in the event of court action, Florida Courts will have jurisdiction and the governing venue will be Leon County, Florida. The Agreement has been reviewed and approved as to form by the Office of the County Attorney and Risk Management Division.

Fiscal Impact
Fiscal Impact/Cost Summary:
There is no County cash or in-kind match required for this Agreement. Funding in the amount of $138,464 will be available in the Substance Abuse Services Grant Fund (93024). The County will be reimbursed by the funder on a monthly basis for medicine and treatment services at the unit rate specified in the Agreement.
