MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, AMENDING SECTION 15-176 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE") PERTAINING TO THE POWERS OF THE BROWARD COUNTY HEALTH FACILITIES AUTHORITY; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of August 14, 2018.
What Action Accomplishes
Amends the Broward County Code of Ordinances to implement staff recommendations approved by the Board resulting from mandatory periodic review of all existing Broward County boards, authorities, and agencies.

Summary Explanation/Background
Section 2.09 of the Broward County Charter and Section 1-245 of the Broward County Code of Ordinances ("Code") provide for the periodic review of all existing Broward County boards, authorities, and agencies. In 2016, the Board of County Commissioners ("Board"), through the Intergovernmental Affairs/Boards Section ("IABS"), conducted a review of all existing Broward County boards, authorities, and agencies pursuant to the Code ("Sunset Review"). As part of the Sunset Review, IABS provided the Board with numerous recommendations with respect to these boards, authorities, and agencies ("Sunset Recommendations"). On August 22, 2017, the Board directed the Office of the County Attorney to prepare the documents necessary to effectuate the Sunset Recommendations. The Sunset Recommendations have been implemented for all applicable boards, authorities, and agencies, except for two: the Broward Regional Emergency Medical Services Council and the Broward County Health Facilities Authority. The attached Ordinance will implement the Sunset Recommendations for the Broward County Health Facilities Authority.

County staff is still attempting to resolve the Broward Regional Medical Services Council's concerns with the Sunset Recommendations.
