MOTION TO WAIVE permit requirement for work on a County road (Chapter 25, Exhibit 25.A of the Broward County Administrative Code) for the Florida Department of Transportation's improvement project on NW 136th Avenue from the north right-of-way line of westbound SR 84 to approximately 800 feet north of North New River Canal’s north right-of-way line. (Commission Districts 1 and 5)

Why Action is Necessary
A. Board of County Commissioners' approval is required to enter into a legal agreement with the Florida Department of Transportation.
 
B. Board of County Commissioners' approval is required to waive the permit requirement for construction in County right-of-way.
What Action Accomplishes
A. Establishes the responsibilities of the County and the Florida Department of Transportation regarding improvements on NW 136th Avenue from the north right-of-way line of westbound SR 84 to approximately 800 feet north of North New River Canal’s north right-of-way line.
 
B. Allows the Florida Department of Transportation to make improvements to a County road without securing a permit from Highway Construction and Engineering Division.

Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

This item supports the Board of County Commissioners' Value of "cooperatively delivering an efficient and accessible regional intermodal transportation network" with the Goal of supporting the "development, design and construction of sustainable, multi-modal transportation facilities throughout the County, to meet the demands of residents, travelers, and businesses."

NW 136th Avenue from the north right-of-way line of SR 84 to 800 feet north of the New River Canal’s north right-of-way line is a six-lane divided road under the jurisdiction of Broward County in the Cities of Sunrise and Plantation. The project is a collaborative effort among Broward County, the Florida Department of Transportation (FDOT) and the Cities of Sunrise and Plantation. As part of this cooperative effort, FDOT and the City of Sunrise will fund the project, FDOT will also manage the design and construction administration, and Broward County will continue to own and maintain the road after construction of the proposed improvements. The project location is shown in Exhibit 2 and improvements include:
  • Construction of three 11-foot lanes, a five-foot bike lane, guardrail, and an eight-foot sidewalk with 42-inch pedestrian railing on northbound NW 136th Avenue.
  • Construction of two 11-foot through lanes, two 11-foot left turn lanes, one 11-foot right turn lane, a five-foot bike lane, and an 8.5-foot sidewalk with 42-inch pedestrian railing on southbound NW 136th Avenue.
  • Reconstruction of NW 136th Avenue northbound and southbound bridge over New River Canal to provide a third southbound through lane and construction of a four-foot traffic separator between northbound and southbound travel lanes.
  • Addition of new signage for southbound turning movements on NW 136th Avenue and replacement of the existing diagonal span wire at the westbound SR 84 intersection with new mast arm assemblies.
  • Construction of additional French drain system and improved interconnects to the existing drainage system to accommodate the added impermeable areas within the project limits.
Motion A would approve a Highway Maintenance Memorandum of Agreement for the NW 136th Avenue and SR 84 improvement project. The agreement allows FDOT and its contractors to enter County right-of-way and construct the project. Additionally, this agreement provides for cooperation between FDOT and County to address utilities and unforeseen conditions. It also requires the contractor to include Broward County as an additional insured party on all insurance policies that are required by FDOT in the contractor's performance of the work.
 
The Broward County Administrative Code, Chapter 25, Exhibit 25.A requires all construction in Broward County right-of-way to be permitted by the Highway Construction and Engineering Division. FDOT will be designing and constructing the entire project. FDOT is requiring Broward County to waive this permit requirement in order to be consistent with its management of similar projects with other governmental agencies.
 
Motion B would waive the permit requirement of the Broward County Administrative Code, Chapter 25, Exhibit 25.A for this project. Staff from the Highway Construction and Engineering Division participated in the plan review process. Furthermore, FDOT's contracting and construction procedures are substantially equal to the County's requirements and provide adequate protection for the public.
 
The agreement has been reviewed and approved as to form by the Office of the County Attorney.
