Summary Explanation/Background
On September 12, 2015, Mark Settipane, on his mobility scooter, was traveling on a Broward County bus. His unrestrained scooter tipped over while the bus turned. Mr. Settipane, who suffered from muscular dystrophy, claimed to have sustained injuries to his ribs and lung. His condition worsened, requiring him to be hospitalized and to undergo emergency surgery. Mr. Settipane lapsed into a coma shortly after surgery, and died on September 18, 2015. The cause of death was attributed to complications of blunt force chest injury and trauma.
 
The Plaintiff's estate has agreed to release Broward County from all claims arising from this incident in exchange for $109,000.00, inclusive of costs and attorney's fees, subject to approval by the Board of County Commissioners.
 
The Risk Management Division and the Broward County Transit Division concur with and recommend approval of this settlement.

Fiscal Impact/Cost Summary:
The source of funds is the County's general liability self-insurance fund.  Agencies of the County pay annual premiums into the fund based upon the number of their employees and five-year claims history.
