THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action will amend the Agreement to fund additional professional engineering services for utilities and pavement projects such as the exit roadways, design and construction of new utilities, drainage systems and airfield modifications for FLL and HWO, replace selected Agreement language and extend the contract term by adding two additional one year optional renewal periods.
The Office of Economic and Small Business Development ("OESBD") established a County Business Enterprise ("CBE") goal of 20% for this project. Keith and Associates, Inc., committed to 20% CBE participation. To date, Keith & Associates has been paid $2,000,073, has paid CBE firms $350,319 and attained a 17.52% participation goal (See Exhibit 3).
On June 2, 2015 (Item No. 15), the Board approved the award of the Agreement between Broward County and Keith and Associates, Inc., for Professional Consultant Services for FLL and HWO Airports, Utilities and Pavement Projects, in the total not-to-exceed amount of $8,000,000. The total amount includes the lump/maximum not-to-exceed amount of $7,600,000 for labor and $400,000 for reimbursable expenses. The initial term of this Agreement was three years with two additional one year renewal periods through June 1, 2020, exercisable at the County’s option.
The proposed First Amendment will provide funding for continued design services, construction administration and inspection services throughout the duration of multiple Capital Development projects. Work includes exit roadways, miscellaneous utilities, drainage improvements and landside and airfield pavement modifications projects. The proposed First Amendment also amends Article 5 to increase the Agreement in a not-to-exceed amount of $4,000,000 in the following: Section 5.1 to reflect the increased lump sum/maximum not-to-exceed Fees amount from $7,600,000 to $11,100,000 for labor, Section 5.1.4 to reflect the increased reimbursable amount from $400,000 to $900,000 and Section 5.3 to include geotechnical investigation, survey and utility locations, for a total Agreement increase from $8,000,000 to $12,000,000.
The First Amendment adds two additional one year optional renewal periods extending the contract time through June 1, 2022. Additionally, the proposed First Amendment deletes and replaces Article 8 of the Agreement to update insurance provisions, Section 10.4 with updated Public Records language and Attachment III in its entirety with the updated BCAD Media Requirements.
The proposed First Amendment has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
