MOTION TO AWARD open-end contract to low responsive, responsible bidder, EZ Caulking & Waterproofing, Inc., for Concrete Floor Resurfacing Services, Bid No. BLD2115493B1, for the Broward County Port Everglades Department, in the annual estimated amount of $1,539,400, which includes allowances in the amount of $10,000; and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $4,618,200. The initial contract period shall begin on the date of award and will terminate one year from that date.

In accordance with the Broward County Procurement Code, Section 21.31.a.4., when the recommendation for award is to a bidder that is not the low bidder, the Board is required to approve all purchases exceeding $500,000.

Provides all labor, materials, equipment and incidentals to resurface concrete floors located in terminals at Port Everglades and other various locations throughout Broward County.

THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 25% for this contract. EZ Caulking & Waterproofing, Inc. committed to 25% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

The purpose of this contract is to provide all labor, materials, equipment and incidentals to resurface concrete floors located in terminals at Port Everglades and other various locations throughout Broward County.

The allowance item included in this contract, in the amount of $10,000, is for project-specific requirements not covered by a specific line item, but necessary to complete a project. Expenditures under this allowance item must be approved by the contract administrator and will be reimbursed at the contractor's actual incurred cost, without mark-up.

The Director of Purchasing has determined the apparent low bidder, Stone Concept Miami, Inc., to be non-responsive based upon OESBD's findings that the bidder was non-compliant with the CBE requirements of the bid.

In accordance with the Broward County Living Wage Ordinance, Section 26-101 (i), these services are subject to the Living Wage. EZ Caulking & Waterproofing, Inc. has agreed to be bound to the contractual obligations of the Living Wage Ordinance.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. EZ Caulking & Waterproofing, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.

The Broward County Port Everglades Department has reviewed the bid submitted by EZ Caulking & Waterproofing, Inc., and concurs with the recommendation for award (Exhibit 3). No vendor performance evaluations have been completed for EZ Caulking & Waterproofing, Inc.

Incumbent: Shotblast Floors, Inc., Contract No. X1126607B1, Concrete Floor Resurfacing Services; Contract Term: September 10, 2013 through September 9, 2016. Expenditures to date: $608,190.

The bid validity for this project expired on August 2, 2018. EZ Caulking & Waterproofing, Inc. agreed to extend its bid validity through October 31, 2018 for Bid No. BLD2115493B1.

There was no protest or appeal filed regarding this procurement.

The bid posted on March 14, 2018 and opened on April 4, 2018; three bids were received with one declination (Exhibit 1).
