THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
Parcel 1. The vacant parcel of land is identified by Folio Number 4942-32-01-2740, approximately 2,500 square feet, and located on the east side of NW 27th Avenue north of NW 15th Street in Broward Municipal Services District (BMSD). It is unsuitable for development due to its size. The minimum lot size is 3,300 square feet for RD-10 (Duplex Dwelling Maximum ten Units per Acre) zoning district in BMSD. The Broward County Property Appraiser assesses the parcel’s value at $5,000.
Parcel 2. The vacant parcel of land is identified by Folio Number 4942-32-01-3530, approximately 2,699 square feet, and located at the northwest corner of NW 27th Avenue and NW 15th Street in Broward Municipal Services District. It is unsuitable for development due to its size. The minimum lot size is 3,300 square feet for RD-10 (Duplex Dwelling Maximum ten Units per Acre) zoning district in BMSD. The Broward County Property Appraiser assesses the parcel’s value at $5,400.
Parcels 1 and 2 escheated to Broward County for non-payment of taxes. Titles were conveyed to the County via tax deeds pursuant to Florida Statutes, Section 197.502(8) since there were no bidders at public sale.
Parcel 3. This portion of vacant parcel of land is identified by Folio Number 5042-29-01-1246, approximately 6,651 square feet, and located on the west side of Ravenswood Road south of SW 42nd Street in Dania Beach. The L-shaped parcel is zoned C-2 (Commercial) under Dania Beach zoning codes and deemed unbuildable due to its configuration and use. The Broward County Property Appraiser assesses the parcel’s value at $3,390.
The County acquired this parcel on March 8, 1991 by quit-claim deed as recorded in Official Records Book 18353, Page 732 of the Public Records of Broward County. Staff has determined that due to its length and width, this portion of parcel cannot be used for right-of-way and is no longer needed for County purposes.
All applicable Broward County agencies were solicited for potential County use of these properties or rights therein; no current or future use was identified for these parcels. However, for Parcel 2, Highway Construction and Engineering Division requested to retain an easement to allow for future County use including but not limited to traffic signs and sidewalks. Upon the sale of Parcel of 2, a separate easement in favor the County will be simultaneously recorded with the deed of conveyance.
Pursuant to Florida Statutes, Section 125.35(2), "[w]hen the board of county commissioners finds that a parcel of real property is of insufficient size and shape to be issued a building permit for any type of development to be constructed on the property... and when, due to the size, shape, location, and value of the parcel, it is determined by the board that the parcel is of use only to one or more adjacent property owners, the Board may effect a private sale of the parcel" by sending notice to the adjacent property owners and accepting sealed bids from such property owners. The Board of County Commissioners may convey the property to the highest bidder or may reject all offers.
In the event no adjacent owner submits a bid to purchase any or all properties, staff recommends a sale offering be conducted through a bid process under Florida Statutes, Section 125.35(1) wherein the Board of County Commissioners has the authority to reject all bids in the event they are too low.
