MOTION TO APPROVE Third Amendment to the Office Lease Agreement between Broward County, Florida, as tenant, and ACP Partners, LLC, as landlord, for Broward County Aviation Department office space, extending the term of the agreement for one additional year, through March 31, 2020; and authorize the Mayor and Clerk to execute same.

Extends the term of the current Office Lease Agreement (“Agreement”) for Broward County Aviation Department ("BCAD") office space for a period of one year, through March 31, 2020.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This action approves the Third Amendment to the Agreement for BCAD office space extending the term one additional year, through March 31, 2020.

On December 6, 2011 (Item No. 53), the Board approved the Agreement with ACP to authorize BCAD to occupy 23,778 square feet of office space for a term of five years commencing on April 1, 2012, with two one year options to extend. The Agreement authorized the Director of Aviation to exercise each extension.

On August 11, 2015 (Item No. 6), the Board approved the First Amendment to the Agreement modifying the rentable square feet of office space, reducing the total square feet from 23,778 to 23,648, designating 95 parking spaces and adjusting the rent accordingly.

On March 2, 2017, the first one year option to extend the term of the Agreement through March 31, 2018, was entered into by the Director of Aviation as authorized pursuant to Section 3(b)(4) of the Agreement.

On October 22, 2017, the second and final year option to extend the term of the Agreement through March 31, 2019, was executed by the Director of Aviation as authorized pursuant to Section 3(b)(4) of the Agreement.

This Third Amendment to extend the Agreement through March 31, 2020 is required in order to provide sufficient time to effectively prepare and efficiently relocate BCAD staff to their new office location in the Terminal 4 building.

This item has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.

Fiscal Impact
Fiscal Impact/Cost Summary:
The current annual rent is $331,796. Upon Board approval of this Third Amendment, the annual rent effective April 1, 2019, shall increase by 3% to $341,750 without any further adjustment.
