MOTION TO APPROVE First Amendment to the System and Services Agreement Between Broward County and Radio One, Inc., dated March 22, 2018 ("Agreement"), to increase the not-to-exceed amounts for Optional Services from $300,000 to $2,750,000 for additional goods and services that include professional services for various County departments and divisions, including Aviation, Convention Center, ORCAT, Port Everglades, Solid Waste and Traffic Engineering; authorizing the purchase of additional equipment as Optional Services through a purchase order up to a not-to-exceed amount of $800,000 for various County departments and divisions as well as an outside agency; and authorizing the Director of Purchasing to execute Work Authorizations up to the applicable not-to-exceed amount.

Why Action is Necessary
In accordance with Section 21.31.a.4 Broward County Procurement Code, all awards greater than the award authority of the Director of Purchasing require Board approval.
What Action Accomplishes
Amends the existing Radio One Agreement, which provides for Broward County's existing Local Government (non-public safety) Radio system, to expand the scope of services and applicable not-to-exceed amounts, to address the needs of various County agencies that require local government (non-public safety) digital radio purchases and/or upgrades.

Summary Explanation/Background
THE OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMENDS APPROVAL OF THE ABOVE MOTION.

On June 13, 2017, the Broward County Board of County Commissioners authorized the Director of Purchasing to execute the System and Services Agreement Between Broward County and Radio One, Inc. to provide an upgrade to Broward County’s local government radio system. The agreement was executed on March 22, 2018.

Other Broward County agencies have subsequently expressed interest in updating their local government (non-public safety) radio systems or purchasing new local government (non-public safety) radios and accessories utilizing the Agreement. The proposed First Amendment increases the not-to-exceed amount for Optional Services that require a scope of work that includes professional services to $2,750,000 for any County department, division, or agency in Broward County to purchase any additional or Optional Services offered by Provider that are reasonably related to the types of goods and services otherwise provided under the Agreement, such as implementation, professional services, and support and maintenance for any other local government (non-public safety) radio system implemented or updated within Broward County. The proposed First Amendment also permits the purchase of additional local government (non-public safety) radio equipment (that which does not require professional services other than support and maintenance) as Optional Services utilizing a purchase order with a not-to-exceed amount of $800,000 for Broward County agencies. The proposed First Amendment authorizes the Director of Purchasing to execute Work Authorizations for which the total cost to the County in the aggregate is $50,000 or more, up to the applicable not-to-exceed amount.

The Broward County School Board, or any other entity deemed an Eligible Purchaser per Section 14.30 of the Agreement, may piggyback off the terms and conditions contained in the Agreement to purchase goods or services from Radio One. However, any such purchase made by an Eligible Purchaser will not be subject to the not-to-exceed amounts listed in the First Amendment and will not be binding on County.
