MOTION TO APPROVE Interim Contract No. R1048101X1, Group Prepaid Legal Insurance Services for Broward County employees with U.S. Legal Insurance Services, Inc., in accordance with the terms and conditions of Contract No. R1048101R1 on a month-to-month basis, not-to-exceed 12 months, to allow for the completion of the rebid and award of the new agreement.

Why Action is Necessary

In accordance with Broward County Procurement Code, Section 21.43, all awards of contracts renewed beyond five years shall be approved by the Board. 

What Action Accomplishes

Provides for the continuation of the legal prepaid insurance services on a month-to-month basis for a maximum of 12 additional months, while the County completes the competitive selection process for the most qualified firm to provide the services.

Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE HUMAN RESOURCES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not establish a goal requirement for this project.

On December 5, 2017 (Item No. 58), the Board approved the motion to reject all proposals for Request for Proposal (RFP) No. R2114349P1, Group Prepaid Legal Insurance Services and approved the extension of Agreement No. R1048101R1 for Group Prepaid Legal Insurance Services on a month-to-month basis not-to-exceed six months, to allow for the rebid of a new agreement. With this extension, the Agreement is set to expire on June 30, 2018.

On February 27, 2018 (Item No. 56), the Board approved Request for Proposals (RFP) No. OPN2116245P2, Group Prepaid Legal Insurance Services (REBID), and authorized the County Administrator to approve the final ranking of qualified firms and the Director of Purchasing to approve and execute the final agreement. The initial closing date was extended for one week from March 30, 2018 to April 6, 2018, due to lack of vendor responses. Four firms submitted proposals by the solicitation closing deadline.

On April 30, 2018, a copy of the Response Log and link to the Purchasing Division online Repository containing the solicitation and the submittals were sent to the Evaluation Committee by the non-voting Evaluation Committee Chair from the Purchasing Division.

On May 11, 2018, the originally scheduled Final Evaluation Committee Meeting was changed to a Combination Initial and Final Evaluation Committee Meeting for RFP No. OPN2116245P2, Group Prepaid Legal Insurance Services (REBID). In addition, the draft Purchasing Director Memorandum and four supporting memoranda from the Office of Economic and Small Business Development, the Finance and Administrative Services Department, the County Attorneys’ Office, and the Risk Management Division were sent by email to the four vendors. The vendors were given the opportunity to make an explanation in writing of any specific deficiencies they found by 5:00 p.m., Tuesday, May 15, 2018.

On May 29, 2018, the Combination Initial and Final Evaluation Committee Meeting for RFP No. OPN2116245P2, Group Prepaid Legal Insurance Services (REBID) was held to score and rank the firms. The proposed recommendation of ranking will be posted from May 30, 2018 to June 4, 2018. The Final recommendation of ranking will be posted from June 5, 2018 to June 11, 2018. The requested interim contract will provide the time necessary to finish the procurement process and negotiate a new agreement with the number one ranked vendor.

The current vendor, U.S. Legal Services, Inc., has agreed to extend the existing agreement on a month-to-month basis not to exceed 12 months, based on the same pricing, terms and conditions as set forth in the current agreement (Exhibit 2). This Agreement and the extension term has no fiscal impact to Broward County as premiums are voluntarily paid through enrolled plan participants.

Fiscal Impact/Cost Summary:

There is no fiscal impact to Broward County, as this requirement is funded in its entirety by voluntary enrollment of benefit-eligible plan participants.
