B. MOTION TO APPROVE Lease Agreement for the Pompano Beach Public Library between Broward County (Tenant) and the City of Pompano Beach (Landlord) for approximately 25,836 square feet located at 50 West Atlantic Boulevard in Pompano Beach for a term of 50 years at a rental rate of $1 per annum; and authorize the Mayor and Clerk to execute same. (Commission District 4)

Why Action is Necessary
Motion A: Board of County Commissioners' approval is required for interlocal agreements.

Motion B: Board of County Commissioners' approval is required to lease property pursuant to Broward County Administrative Code, Section 6.23.
What Action Accomplishes
Motion A: Amends the Agreement for Programming, Design and Construction of a Library Facility to address the public art component and changes made during the design and construction phase.

Motion B: Provides Broward County with a 50-year lease for the new Pompano Beach Library.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND LIBRARIES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On August 30, 2011 (Item No. 52), the Board of County Commissioners approved an Interlocal Agreement (ILA) for Programming, Design, and Construction of a Library Facility among the County, the Pompano Beach Community Redevelopment Agency and the City of Pompano Beach. The ILA set forth the terms and conditions for the design and construction of a library to replace the existing library located at 1213 E. Atlantic Boulevard in Pompano Beach. The ILA provided that the library would occupy the ground floor and a cultural center would occupy the second floor of the facility. In addition, upon completion of construction, the City would lease the library portion to the County. 

After execution of the ILA, the design for the facility was changed so that both the library and cultural center would occupy both floors. The proposed Amendment reflects the final design and construction of the facility and addresses changes to the public art component. The proposed lease agreement is for a 50-year term at a rental rate of $1 per year. The term may be extended in 50-year increments. Broward County is responsible for its pro rata share of the utilities.
