MOTION TO APPROVE First Amendment to the Interlocal Agreement between Broward County and City of West Park for conveyance of property consisting of 0.56 acres located on Pembroke Road and NW 57th Avenue within the City of West Park from County to City for Community Development Activity; authorizing the County Administrator to execute the Amendment to the Interlocal Agreement as approved by the County Attorney. (Commission District 8)

What Action Accomplishes
Action provides the City of West Park with additional time to develop the site pursuant to the original agreement, requiring payment to the County for the property if it is not developed within the specified timeframe.

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE HOUSING AND COMMUNITY REDEVELOPMENT DIVISION RECOMMEND APPROVAL OF THIS MOTION. 

On March 11, 2008 (Item  No. 2), the Board approved an Interlocal Agreement between Broward County and the City of West Park for conveyance of property from Broward County to the City of West Park for development, improvement and use of the land consistent with Community Development Block Grant (CDBG) eligible activities under the federal Department of Housing and Urban Development rules and regulations. The property had been purchased by the County with CDBG funding. This property consists of 0.56 acres and is located on Pembroke Road and NW 57th Avenue within the City of West Park. The Interlocal Agreement required the development of the site within a ten year period or the property would revert back to the County. The Interlocal Agreement also provided that, at the request of the City of West Park, the Board may extend the time to develop the property. 

Beginning in March, 2018, meetings were held between County and City representatives wherein the City requested that the Interlocal Agreement be extended to provide additional time to develop the site. Therefore, it is being recommended that the City be provided an additional two years to develop; but, if that should not occur, the City would be required to either pay the County the market value at the time for the property or the property would revert to the County.
