THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL ENGINEERING AND PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This action supports the Board's Value of "[e]ncouraging investments in renewable energy, sustainable practices and environmental protection" and corresponding goal to "[s]eek funding for, implement policies and pursue projects promoting the use of alternative energy, resource conservation, sustainable practices and environmental protection"; conservation and environmental protection is achieved by insuring that the mitigation area will remain wetlands in perpetuity.
On May 24, 2016, the Board approved the “Agreement between Broward County and R & R Davie, LLC, for Release of a Conservation Easement and Grant of New Conservation Easement” (Exhibit 1), which contained conditions for the release of a 2.91-acre conservation easement and a timeline for the construction of a new wetland restoration and enhancement area.
The Agreement required that the new wetland restoration and enhancement area be constructed and the Time Zero report be submitted within one year of the Release of the Joint Deed of Conservation Easement. The Release of Joint Deed of Conservation Easement and Agreement was executed and recorded on May 19, 2017 (Instrument No. 114396652). Despite diligent efforts, R & R Davie, LLC, will not complete the planting, as-built drawings, and Time Zero Report submittal by May 19, 2018. Therefore, an Amendment to the Agreement (Exhibit 2) is necessary for an additional six months to complete the planting and reporting requirements.
