Board of County Commissioners' approval is required to accept roads from municipalities pursuant to Florida Statutes, Section 335.0415.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND WATER AND WASTEWATER SERVICES RECOMMEND  APPROVAL OF THE ABOVE MOTION.

The City of Pompano Beach has jurisdiction over the subject right-of-way, which is a portion of NE 51st Street and adjacent to the Broward County Water and Wastewater Services plant located at 1390 NE 50th Street in Pompano Beach. The Folio Number affected by this proposed action is 4843-07-02-3040. Currently, a fence is located across a portion of the property. Due to its location, vehicles often park alongside the fence which is within 120 feet of a water tank creating safety and security concerns. Staff requested transfer of the 70-feet-wide by 200-feet-long portion of NE 51st Street from the City of Pompano Beach to allow the County to realign the fence 120 feet to the east which will keep vehicles a minimum of 240 feet from the water tank.

Florida Statutes, Section, 335.0415 allows for the transfer of public roads between jurisdictions by mutual agreement. The City of Pompano Beach approved the transfer on January 23, 2018 and recorded a Quitclaim Deed to the County on February 8, 2018. Approval of this item constitutes formal acceptance by the Board of County Commissioners of the transfer.
