MOTION TO ADOPT Resolution No. 2018-269 of the Board of County Commissioners of Broward County, Florida, providing for a referendum election to be held on November 6, 2018, to determine whether to levy a one percent (1%) Charter County and Regional Transportation System Sales Surtax, and directing the County Administrator to furnish a copy of the adopted Resolution to the Broward County Supervisor of Elections on or before June 18, 2018, for the purpose of placing the item on the November 6, 2018, General Election ballot. The title of the Resolution is as follows:
 
AN ENABLING RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, SCHEDULING A REFERENDUM ELECTION TO BE HELD AT THE GENERAL ELECTION ON NOVEMBER 6, 2018, FOR THE PURPOSE OF DETERMINING WHETHER TO LEVY A ONE PERCENT (1%) CHARTER COUNTY AND REGIONAL TRANSPORTATION SYSTEM SALES SURTAX COMMENCING JANUARY 1, 2019, FOR A PERIOD OF THIRTY (30) YEARS, AS AUTHORIZED BY STATE LAW; PROVIDING FOR THE DELIVERY OF A CERTIFIED COPY OF THIS ENABLING RESOLUTION TO THE SUPERVISOR OF ELECTIONS BY JUNE 18, 2018; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

The proposed Resolution was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners.

The proposed Resolution schedules a countywide referendum on November 6, 2018, to determine whether to levy a 1% Charter County and Regional Transportation System Sales Surtax ("Transportation Surtax"), as authorized by state law, for a period of thirty (30) years.

Summary Explanation/Background
Section 212.055(1) Florida Statutes, provides for the levy of a Transportation Surtax, at a rate of up to 1%, by enactment of an ordinance by a majority of the members of the Board of County Commissioners ("Board"), subject to approval by a majority of the electors of Broward County voting in a referendum election on the Transportation Surtax.
 
The proposed Resolution, if adopted, will schedule a countywide referendum to be held at the General Election on November 6, 2018, for the purpose of determining whether to levy a 1% Transportation Surtax for a period of thirty (30) years, commencing on January 1, 2019, and expiring on December 31, 2048. The proceeds of the Transportation Surtax would be required to be expended for transportation and transit purposes authorized in Section 212.055(1)(d), Florida Statutes, as further specified in the Resolution's proposed ballot language.
 
A proposed ordinance levying a 1% Transportation Surtax for a period of thirty (30) years, subject to electorate approval, is set for public hearing on June 5, 2018.

Fiscal Impact
Fiscal Impact/Cost Summary:
It is estimated that the levy of one cent of local option sales tax for transportation would generate $357.4 million in revenue the first full fiscal year in 2020.
 
The tax would be effective January 1, 2019, and the first proceeds are anticipated to be received by the end of March 2019; therefore, only a partial year of revenues would be received in FY19.
