MOTION TO APPROVE First Amendment to Agreement between Broward County and Kimley-Horn and Associates, Inc., Agreement No. R1083508R1, Professional Services for Rehabilitation of North Airfield Pavements and Engineered Material Arresting System Beds for Broward County's Fort Lauderdale-Hollywood International Airport, for additional scope and to delete and replace certain Agreement Exhibits, for an increase in the not-to-exceed amount of $1,836,252, increasing the total Agreement amount from $2,100,000 to $3,936,252; and authorize the Mayor and Clerk to execute same.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.94.a, any changes, including amendments to agreements must be approved by the appropriate award authority, based on the amendment amount.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This action will amend the Agreement to fund additional design scope, pay for construction phase services such as construction administration and replace certain Agreement Exhibits for the rehabilitation of the North Runway project at FLL.

The Office of Economic and Small Business Development ("OESBD") established a Disadvantaged Business Enterprise ("DBE") goal of 19% for this project. Kimley-Horn and Associates, Inc. ("Kimley-Horn") committed to 20% DBE participation. To date, Kimley-Horn has been paid $636,443 and has paid DBE firms $88,009, for 13.83% DBE participation. Kimley-Horn expects to reach its DBE goal during the on-going design phase (Exhibit 3).

On March 17, 2015 (Item No. 20), the Board approved the award of the Agreement between Broward County and Kimley-Horn, for Professional Services for Rehabilitation of North Airfield Pavements and Engineered Material Arresting System Beds, in the total not-to-exceed amount of $ $2,100,000. The total amount includes the lump/maximum-not-to exceed amount of $1,660,834 for basic services, $60,000 for reimbursable expenses and $379,166 for optional services.

The original construction of the North Runway dates back to circa 1943. Its last rehabilitation occurred in 2004. The North Runway handled 100% of FLL traffic for a year and a half until the opening of the new South Runway. The North Runway needs to be kept in sound operational condition and compliant with Federal Aviation Administration ("FAA") standards.

In November 2015, after the completion of the Program Verification Phase ("PVP"), Broward County placed a hold on the design phase of the North Runway Project in order to better align the anticipated closure period for the runway repair with the completion of the Residential Sound Insulation Program.

Subsequent to extensive analysis of all the options available, and after discussions with the FAA and the airlines, in September 2017, the CEO/Director of Aviation authorized the continuation of the design phase with the selection of a preferred option to replace the keel section (center portion) of the North Runway with concrete. The choice of using concrete material results in a longer lifespan for the runway. Additional design changes due to compliance with FAA guidelines and the complexity of the selected option resulted in additional Consultant design fees. As the completion schedule of the Residential Sound Insulation Program was accelerated, this was no longer an impact to the closure of the North Runway.

The proposed First Amendment provides funds for added design scope during the PVP that includes the relocation of Taxiways “D” and “T2”, Geometry Modification for compliance with FAA design standards, and construction phase services to include construction administration. This First Amendment also deletes and replaces certain Agreement Exhibits for the rehabilitation of the North Runway project at FLL.

The proposed First Amendment also amends Article 5 to reflect the revised total not-to-exceed Agreement amount increase from $2,100,000 to $3,936,252, Section 5.1 to reflect the increased lump sum/maximum not-to-exceed Fees Amount from $1,660,834 to $3,476,252, Section 5.1.3 to reflect the Optional Services amount decrease from $379,166 to $350,000 and Section 5.1.4 to reflect the increased Reimbursables amount from $60,000 to $110,000.

Additionally, the proposed First Amendment deletes and replaces Section 10.4 of the Agreement with the updated Public Records language found in Paragraph 5, Exhibits B (Salary Costs), Exhibit B-1 (Key Staff), Exhibit C (Schedule of Subconsultants), Exhibit F (Optional Services) and Attachment III (Electronic Media Submittal Requirements).

The proposed First Amendment has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.

The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the maximum amount payable under this Agreement. The Agreement Summary Sheet reflects the actual amount of the award.
