Requested Action
A. MOTION TO AUTHORIZE County Administrator to take any and all necessary actions as needed including execution of contracts, licenses and other administrative documents between Broward County, the City of Fort Lauderdale and other authorities having jurisdiction to obtain permits and other approvals for new and on-going projects located within the Broward County Judicial Complex campus, subject to the Office of the County Attorney approving any contracts as to legal sufficiency, during the Board of County Commissioners' 2018 summer break. (Commission District 7)

B. MOTION TO AUTHORIZE County Administrator to take any and all necessary actions as needed, including approval of RFP’s/RLI’s, execution of agreements, contract amendments, work authorizations, construction change orders, budget Resolutions, leases, and other administrative documents to provide for continued post-construction phase services, retrofits, non-warranty repairs, and other design and construction services deemed necessary in relation to facility operations for the New Broward County Courthouse and to ensure the continuation of future phases, the East Wing renovation, and other minor projects within the Broward County Judicial Complex campus by James A. Cummings, Inc., Spillis Candela & Partners/Heery/Cartaya Joint Venture, The Weitz Company, and other vendors and suppliers  as deemed necessary, subject to the Office of the County Attorney approving any contracts as to legal sufficiency, during the Board of County Commissioners' 2018 summer break. (Commission District 7)

Why Action is Necessary
MOTIONS A and B: Board of County Commissioners’ approval is required to delegate authority to the County Administrator to enter into agreements and execute work authorizations, amendments and other administrative documents with either a dollar value in excess of the Purchasing Director's authority or that otherwise require Board of County Commissioners’ approval while the Board of County Commissioners is not in session.

MOTIONS A and B: Authorizes the County Administrator to take actions on behalf of the Board of County Commissioners as may be deemed necessary to ensure continuing progress on new and on-going projects within the Broward Judicial Complex while the Board of County Commissioners is not in session.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

The New Broward County Courthouse has been in operation for over a year, with full occupancy and daily use. Necessary building refinements beneficial to the security, accessibility and usability of the new facility continue to reveal themselves. These building adjustments are outside the scope of the initial design and construction, and often require design input, permits, construction, and service provisions through County-held master agreements or separate procurements. The enabling authority for these actions may rise to a level above that of the Purchasing Director and require Board of County Commissioners’ approval. As some of these actions are also time sensitive, delegation of the Board of County Commissioners’ approval to the County Administrator during the upcoming 2018 summer break will ensure expedient completion of these post-occupancy tasks.

There are numerous other on-going projects at various levels of completion in the Broward County Judicial Complex. These projects include: preparatory work for the demolition of the West and Central Wings, design finalization and construction of the 500-car secure parking garage and public plaza, design of future East Wing renovation, and backfilling of space made vacant by occupancy of the new tower. As these projects are time sensitive various amendments, work authorizations, and change orders may be necessary during the Board of County Commissioners’ 2018 summer break. Delegation of the Board of County Commissioners’ approval to the County Administrator for the 2018 summer break will ensure expedient completion of those on-going, time sensitive project tasks.

The proposed Motion A will authorize the County Administrator to execute the agreement(s), license(s) and other administrative documents as may be necessary to obtain permits and other jurisdictional approvals during the Board of County Commissioners’ 2018 summer break. This motion is presented as a contingency measure in order to avoid project delays.

Motion B asks the Board of County Commissioners to delegate signature authority to the County Administrator for amendments, work authorizations, change orders and other documents as may become necessary to expedite services needed for the completion of the new courthouse tower, including post-construction retrofits and non-warranty repairs, and future phases of the project by either James A. Cummings, Inc. (the Contractor), Spillis Candella & Partners/Heery/Cartaya Joint Venture (the design team), The Weitz Company (the Owner’s Construction Project Manager), and other vendors and material suppliers as may be needed during the Board of County Commissioners’ 2018 summer break. This motion is presented as a contingency measure in order to avoid project delays.
