MOTION TO APPROVE fixed contract with Presidio Networked Solutions, LLC through the State of Florida's Contract No. 43220000-WSCA-14-ACS, Data Communications Projects and Services, for a Wireless Broadband Mesh Network System for the Port Everglades Department, in the amount of $512,704, to be partially reimbursed by Port Security Grant No. EMW-2015-PU-00429.

Why Action is Necessary
In accordance with Broward County Procurement Code, Section 21.36, the Director of Purchasing may purchase directly, without bids or quotations, from a General Services Administration (GSA) contract or from federal, state or local contracts if the awarding jurisdiction and/or the vendor agree to allow the County to purchase therefrom. Additionally, in accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all awards exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND THE APPROVAL OF THE ABOVE MOTION.

This project is for the purchase and installation of a current industry standard Wireless Broadband Mesh Network System, which will provide the backbone architecture to access Port Everglades Department's (PEV's) security servers. This will also provide redundant and layered security monitoring of PEV's full spectrum of security systems, which include sensors, alarm systems, physical access control systems, personal identification systems, vehicle identification systems, infrastructure monitoring systems, video monitoring systems, and radar systems.

On October 21, 2015, PEV accepted Port Security Grant (Grant) EMW-2015-PU-00429-S01 (Exhibit 1) from the Department of Homeland Security Federal Emergency Management Administration (FEMA) in the amount of $1,265,887 with a condition that PEV matches the Grant at $421,962 (or 25%). The time of performance of this Grant is from September 1, 2015 to August 31, 2018 where all procurements under this awarded grant must be procured including any installation if needed. 

On May 17, 2018, PEV provided a memo requesting to utilize Florida Department of Management Services, Data Communications Projects and Services, Contract No. 43220000-WSCA-14-ACS for the procurement of the Wireless Broadband Mesh Network System (Exhibit 2). The total cost for this project is $512,704. PEV's portion of this amount is 25% ($128,176). 

According to the United States Coast Guard (USCG) Docket No. USCG-2007-28915, Transportation Worker Identification Credential (TWIC) - Reader Requirements, the USCG Final Rule requires certain Maritime Transportation Security Act regulated facilities such as PEV, which have been determined to present a heightened risk of a Transportation Security Incident, to conduct electronic TWIC inspections. The Wireless Broadband Mesh Network System will need to be procured and installed in order to fully interoperate with the TWIC Card Readers throughout PEV's jurisdictional area and to comply with this USCG regulation. The effective date and deadline for compliance of the USCG Final Rule is August 23, 2018.

According to the Code of Federal Regulations (CRF) 200.218.e. - General Procurement Standards, “To foster greater economy and efficiency, and in accordance with efforts to promote cost-effective use of shared services across the Federal government, the non-Federal entity is encouraged to enter into state and local intergovernmental agreements or inter-entity agreements where appropriate for procurement or use of common or shared goods and services.” This CFR encourages the use of inter-entity agreements such as the Florida Department of Management Services, Data Communications Projects and Services, Contract No. 43220000-WSCA-14-ACS which complies with the Grant's CFR regulation requirements.
