MOTION TO WAIVE Chapter 26, Operational Policy, Aviation, Broward County Administrative Code, Section 26.5, Authority to Resolve Protested Solicitations and Proposed Awards, and Section 26.6, Hearing Procedure for Determination of the Purchasing Director, and to provide for the inclusion of the revised protest and appeals process approved by the Board under Chapter 21, Operational Policy, Procurement Code, for Request for Proposals No. 2018-06-05-AV-02, Airport Shuttle Bus and Other Transportation Services.

C. MOTION TO APPROVE Request for Proposals No. 2018-06-05-0-AV-02, Airport Shuttle Bus and Other Transportation Services, to solicit a vendor that can administer and manage all functions of the shuttle bus and other transportation services at Broward County's Fort Lauderdale-Hollywood International Airport.

ACTION:  (T-11:59 AM) Following public comments and Board discussion, the Board deferred this item to Tuesday, June 12, 2018, to allow staff to investigate how to award additional points/scoring to companies that exceed the assigned ACDBE (Airport Concession Disadvantaged Business Enterprise) participation goal in this Request for Proposals (RFP) and in future RFP.   (Refer to minutes for full discussion.)

Why Action is Necessary
Motion A and B. Board of County Commissioners ("Board") approval is required to waive provisions of the Broward County Administrative Code ("Administrative Code").

Motion C. Board approval is required for Request for Proposals.

Motion A. Waives the requirements of Section 26.15(c) of the Broward County Administrative Code, Eligibility Requirements, and  Section 26.15(f), Term.

Motion B. Summary Explanation/Background
THE BROWARD COUNTY AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

The proposed actions as part of the Board item will approve waivers of Sections in Chapter 26 of the Administrative Code relative to the Airport Shuttle Bus and Other Transportation Services procurement at FLL (Motions A-B) and approval of a new Request for Proposal ("RFP") for the Airport Shuttle Bus and Other Transportation Services (Motion C).

Motion A
Chapter 26, Operational Policy, Aviation, Broward County Administrative Code, Section 26.15(c), Eligibility Requirements,  requires each firm or organization to have been in continuous existence for at least the last ten years and to have demonstrated experience in the simultaneous operation, for the last three consecutive years, of public parking facilities at one or more airport or comparable facilities. Section 26.15(f), Term, provides for a term not in excess of five years. A longer term will allow for better pricing of vehicles and contract terms.

The Broward County Aviation Department ("BCAD") is requesting a waiver of Section 26.15(c) and 26.15(f) in Chapter 26 of the Administrative Code to allow a competitive solicitation with the removal of some eligibility requirements and for the addition of five optional one year renewal periods to the proposed initial five year term.

Motion B
Chapter 26, Operational Policy, Aviation, Section 26.5 of the Administrative Code provides for the procedures for protesting a solicitation or a proposed award of a contract under the Concession Policy award process. Section 26.6 provides for the procedures in determining the resolution for a protest. Chapter 26 is not consistent with the Board-approved policy under Chapter 21, Operational Policy, Procurement Code, which includes guidelines to settle and resolve protests and appeals.
 
 
BCAD is requesting a waiver of Section 26.5 and Section 26.6 in Chapter 26 to allow for the inclusion of the guidelines as set forth in Chapter 21, Sections 21.118 through 21.122 of the Procurement Code in the proposed solicitation. This proposed waiver will make the protest resolution and appeals process more efficient and consistent with current County policies.

Motion C
The Office of Economic and Small Business Development has assigned a 12% Airport Concession Disadvantaged Business Enterprise goal for this RFP.

The purpose of this RFP solicitation is to engage the services of a qualified and experienced firm to administer and manage all functions of shuttle bus and other transportation services agreement at FLL. The firm will provide shuttle bus services between and among the terminals, the parking facilities, and any other locations requested to assist with transportation services for airport guests and approximately 15,000 employees. The firm will also provide all transportation to include shuttles, trams and other transportation vehicles to meet the needs of the airport. The transportation of guest and employees may encompass on or off-airport property transportation services. The Proposer will also provide shuttle bus services 24 hours per day, seven days per week, including holidays. 
 
Pursuant to the draft agreement advertised with this solicitation, the selected vendor will be paid a management fee to cover items such as overhead, wages for key personnel, and profit, and an in-service hourly fee for each hour that a vehicle is used for services. In addition to such fees, the selected vendor will be reimbursed for certain out of pocket expenses.
 
The RFP method of procurement was selected for this project to best serve the County with additional evaluation criteria other than price alone. The RFP method provides for predefined evaluation criteria for ranking of firms based upon the required specialized expertise. Proposers are required to determine the best method to accomplish these services.
