Requested Action
MOTION TO AWARD open-end multiple award contracts to all responsive, responsible bidders per Exhibit 2, for Pumps, Various Brands, Bid No. OPN2116051B1, for Water and Wastewater Services, in the annual estimated amount of $275,000, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $825,000. The initial contract period begins on July 17, 2018 and terminates one year from that date.

VOTE: 6-0.  Commissioners Geller, Holness and Sharief were not present.
Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not reserve this project for Small Business Enterprises under the Sheltered Market Program, or assign County Business Enterprise participation goals to this solicitation based on the review of products and services requested (Exhibit 3).

The purpose of this contract is to provide for the purchase of various brands of pumps utilized by Broward County Water and Wastewater Services.

Water and Wastewater Services has reviewed the bids submitted by Moss Kelley, Inc. dba MKI Services, Inc., R. C. Beach & Associa., Inc., Wastewater Solutions, LLC, and World Electric Supply, Inc., and concurs with the recommendation for award (Exhibit 4). Five final vendor performance evaluations have been completed for World Electric Supply, Inc.; the firm has an overall rating of 3.98 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request. There have been no final vendor performance evaluations completed for Moss Kelley, Inc. dba MKI Services, Inc., R. C. Beach & Associa., Inc., or Wastewater Solutions, LLC.

The introduction to the General Conditions section of the solicitation specified that any material modification of the solicitation and/or any alteration of the verbiage is expressly prohibited and is not enforceable, and may render the vendor’s submission void and bar the vendor from consideration in connection with this solicitation. The Director of Purchasing has determined the bidder, Hudson Pump & Equipment, a division of Tencarva Machinery Company, LLC, to be non-responsive as the bidder took exception to the indemnification clause (19) in the General Conditions. All responsive, responsible bidders did not take any exceptions to the terms and conditions of the bid.

The Specifications and Requirements of the solicitation specified in section 3.2 that only manufacturer-authorized dealers/sellers will be eligible to provide products on behalf of the manufacturer. The Director of Purchasing has determined the following bidders to be non-responsive for the following items, as the bidder(s) could not provide proof of authorized distributor status by the manufacturer: The Tools Man, Inc. dba The Tools Man Industrial Supply (Items 5 and 7), and World Electric Supply, Inc. (Items 1, 2, 5, 6, 10, and 12). All responsive, responsible bidders did provide evidence of manufacturer-authorized dealers/sellers status.

Incumbent(s): Barney's Pumps, Inc., Core & Main LP, formerly HD Supply Waterworks, Ltd., Hudson Pump & Equipment Division of Tencarva Machinery Company, The Tools Man, Inc. and World Electric Supply, Inc. Contract Number and Title: Y1422006B1, Pumps, Various Brands. Contract Term: April 18, 2016 through July 16, 2018. Expenditures to date: $247,698.

There was no protest or appeal filed regarding this procurement.

The bid posted on January 24, 2018 and opened on February 9, 2018; six bids were received with no declinations (Exhibit 1).
