Requested Action
MOTION TO APPROVE Amendment No. 1 to the Public Library Construction Grant Agreement 15-PLC-01 between Broward County and the Florida Department of State, Division of Library and Information Services, for the purpose of revising the end date of the agreement from June 1, 2018 to October 1, 2018; all other terms and conditions remain unchanged and authorize the Mayor to execute same. (Commission District 4)

VOTE:  8-0. Commissioner Sharief was not present.
Why Action is Necessary
Board approval is required to approve and execute this grant amendment with the State of Florida.
What Action Accomplishes
Approval of the Amendment to the Grant Agreement extends the project completion date to October 1, 2018 and allows the Libraries Division additional time to submit reimbursement requests to the State.

Summary Explanation/Background
THE LIBRARIES DIVISION RECOMMENDS THE APPROVAL OF THE ABOVE MOTION.

Approval of this item supports the Commission Goal to create a community with vibrant arts, culture, recreation and learning opportunities.

On November 12, 2014, the Board of County Commissioners approved the submission of a Library Services Construction Grant Agreement to the State of Florida for the purpose of constructing a replacement for the Pompano Beach Branch Library. Grant funds in the amount of $500,000 were awarded to Broward County to augment the 1999 Library Bond Issue funding for this project. The grant funds are disbursed to the County in four payments; each of the first three payments represent 30% of the grant award (totaling 90%), and the fourth payment is the final 10% of the award amount. Payments 1 and 2 have been requested and received. The State requires that the County submit documentation for Payments 3 and 4 indicating that amounts payable to the construction contractor have been fully paid, including any retainages.

On August 30, 2011, the County and City of Pompano Beach entered into an interlocal agreement for the City to design, construct and own the replacement library location. The County has fulfilled all its financial obligations to the Library landlord, the City of Pompano Beach. Pompano Beach has not paid its contractor OHL the final $100,000 retention since OHL has not turned over all project closeout documentation nor completed the building commissioning activities. The project has been substantially complete since September 27, 2017, and the Library opened to the public on January 19, 2018. This extension is requested so the City can obtain the missing documentation, release the final retainage and close the agreement with their contractor.  Upon resolution, the County will submit to the State the necessary documentation to support requests for the final grant disbursements.

The new Pompano Beach Library provides a full range of library services to the community, over 60 computers for public access and a Teen Tech Studio.
