MOTION TO ADOPT Resolution No. 2018-238 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, June 5, 2018, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
 
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MOTOR CARRIERS; AMENDING VARIOUS SECTIONS OF CHAPTER 22½ OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE") RELATING TO THE LICENSING AND OPERATION OF FOR-HIRE GROUND TRANSPORTATION SERVICES; REMOVING REGULATIONS RELATED TO TRANSPORTATION NETWORK COMPANIES AND CERTIFIED MOTOR CARRIERS; AMENDING VEHICLE STANDARDS; AMENDING PROVISIONS RELATED TO THE EXPIRATION OF PERMITS; ALLOWING FOR ADDITIONAL TIME FOR REDEMPTION OF WHEELCHAIR ACCESSIBLE CERTIFICATES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

ACTION:  (T-10:53 AM)  Approved, as amended, with Yellow-Sheeted Additional Material, dated May 22, 2018, submitted at the request of Environmental Protection and Growth Management Department.  The Board requested that staff review and consider today’s discussion, as well as review and consider the handout that was distributed to the Board by United Drivers of Broward and bring recommendations back to the Board prior to the Public Hearing of Tuesday, June 5, 2018.  (Refer to minutes for full discussion.)

VOTE:  8-0. Commissioner Sharief was not present.

The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meetings of June 6, 2017, and November 7, 2017.

Summary Explanation/Background
On June 6, 2017, the Board directed the Office of the County Attorney to draft an Ordinance amending various sections of Chapter 22½ of the Broward County Code of Ordinances to comply with State of Florida House Bill 221, now enacted as Section 627.748, Florida Statutes, which preempts local government regulation of transportation network companies ("TNCs"). 
 
On November 7, 2017, the Board further directed the Office of the County Attorney to make the following changes to Chapter 22½:  provide for ride sharing for taxis, improve the current lottery process for issuing certificates of public convenience and necessity, eliminate provisions related to certified motor carriers, and extend the time for redemption of wheelchair accessible vehicle placeholder tickets to 90 days.
 
The proposed Ordinance was drafted in consultation with staff from the Environmental and Consumer Protection Division ("ECPD") and was discussed with members of the taxicab industry who provided feedback and recommendations. The proposed Ordinance includes the following changes: 
  • Sections regulating TNCs and certified motor carriers were either eliminated or amended to comply with Section 627.748, Florida Statutes.
  • The Director of ECPD may allow up to two 90-day extensions for redemption of wheelchair accessible vehicle placeholder tickets.
  • The lottery process for issuing certificates of public convenience and necessity has been revised.
  • Vehicles inspection standards have been streamlined.
  • Permit expiration dates, including airport operating permits and Port Everglades Business Permits, were updated to expire one calendar year after the date of issuance.
