THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
On December 13, 2016 (Item No. 38), the Board of County Commissioners authorized the County Administrator to take any necessary actions to execute a lease(s) on behalf of the Board of County Commissioners to secure emergency leased space for the State Attorneys' Office (SAO) due to the renovations of the East Wing of the Broward County Judicial Complex. The County entered into four leases to accommodate SAO. The leased premises included 4,223 square feet on the first floor of the Advocate Building for $95,074 annually; 6,246 square feet on the third floor of the Advocate Building for $177,378 annually; 9,876 square feet on the first and third floors of the Scherer Building for $382,136 annually and 7,532 square feet on the sixth floor of Courthouse Place for $246,265 annually. With the exception of the Courthouse Place leased space, the other three leases have been terminated as most of the SAO staff are in County-owned properties. Please note that there is still SAO staff remaining in the 110 Tower that will also be relocated once the East Wing renovation project is completed.
The short-term lease for 7,532 square feet in Courthouse Place was executed on March 9, 2017 for a term of one year plus five one-month extensions. The remaining SAO staff located in Courthouse Place will be relocated to the East Wing upon completion of renovations, which are ongoing. The proposed First Amendment extends the term to March 31, 2021 plus three one-year renewals. The rental rate for the first year of the extension term was negotiated down from $35.70 to $35.00 per square foot for a rental rate of $263,620 for the first year. The annual increase in the rental rate was also negotiated down from 3% to 2%. The gross rent requires the landlord to pay for all expenses including water, sewer, electricity, pest control, trash, HVAC, janitorial services and supplies, light bulb replacement, and air conditioning maintenance and AC filter replacement. All other terms and conditions of the lease remain the same.
