Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL

On May 3, 2016 (Item No. 4A), the Board of County Commissioners approved the County Incentive Grant Program Agreement between Broward County, the City of Pembroke Pines and the Florida Department of Transportation (FDOT) for improvements to SW 145th Avenue from SW 5th Street to Pines Boulevard. SW 145th Avenue is under the jurisdiction of the City of Pembroke Pines, and Pines Boulevard is under the jurisdiction of FDOT. Under the agreement, FDOT and the City each agreed to fund 50% of the estimated $214,726 project construction cost, up to $107,363. The County was included in the agreement because the grant program requires County involvement in order for the City to receive funding. The agreement also assigned all of the County’s interest, rights and obligations, financial and otherwise, in the oversight and management of the project to the City.

This amendment will reduce FDOT’s funding participation based on the bid award amount of the project. FDOT’s maximum participation is being reduced from $107,363 to $94,905, which is 50% of the bid award amount of $189,810. The terms of the original agreement with respect to the County’s interest, rights, and obligations will remain the same.

The amendment has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
