Requested Action
MOTION TO AWARD open-end contract to low bidder, Continental Construction, USA, LLC, for Improvements at Broward County Bus Stops, Bid No. V2114813B1, for the Transit Division, in the estimated annual amount of $1,721,264, which includes allowances in the annual amount of $160,000, and authorize the Director of Purchasing to renew the contract for two optional one-year periods, for a potential three-year total amount of $5,163,792. The initial contract period shall begin on the date of award and shall terminate one year from that date, subject to the receipt and acceptance of Performance and Payment Guarantee.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a Disadvantaged Business Enterprise (DBE) participation goal of 30% for this contract. Continental Construction, USA, LLC committed to 30% DBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).
 
This contract provides for the construction of bus stop pads, installation of bus shelters and associated amenities (benches, lighting, trash receptacles, etc.) at various bus stop locations designated by the Broward County Transit Division (BCT), as part of Broward County's Bus Shelter and Bus Stop Improvement Program.

The pass-through allowance items will cover permits, inspections, irrigation system, landscaping,  specialized construction activities, and unforeseen miscellaneous parts and materials. Proof of the actual cost (no mark-ups) of the items being utilized as a pass-thru allowance must be attached to the final invoice submitted to the County for payment.

This procurement carries a 100% Performance Bond and a 40% Payment Bond. The Purchasing Division has confirmed with the surety company that Continental Construction, USA, LLC has the capacity to obtain the required bonds.

The initial bid submitted by Continental Construction, USA, LLC was $1,615,963; the Vendor offered a Voluntary Price Reduction resulting in a savings of $54,700 and a revised total estimated annual amount of $1,561,263. The Broward County Procurement Code, Section 21.30.f.2(c), allows for acceptance of a voluntary reduction after bid opening, if such reduction does not result in the modification or deletion of any condition of the bid.

The Transit Division reviewed the bid submitted by Continental Construction, USA, LLC. and concurs with the recommendation for award (Exhibit 3).

Five vendor performance evaluations were completed for Continental Construction, USA, LLC.; the firm has an overall rating of 3.49 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

The purchasing agent has researched the prices submitted by the recommended bidder, Continental Construction, USA, LLC, and has determined that the prices submitted are fair, reasonable and aligned with market analysis for the industry (Exhibit 4).

The amounts referenced in this agenda were rounded to the nearest whole dollar. Vendor payments will be based on the actual bid amount. The bid tabulation reflects the actual amount of the award.

The bid posted on December 11, 2017 and opened on January 10, 2018; two bids were received with no declinations.

There were no protests received for this solicitation.

Fiscal Impact/Cost Summary:
This project is funded with Federal Transit Administration grant funds budgeted within the Transit Capital Grant Fund.  Each requisition processed against this open-end contract will be funded by the appropriate source at the time of  release.
