THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) designated this project as a reserved project for County Business Enterprise (CBE) firms (Exhibit 2).
The purpose of this contract is to provide roofing services for the Port Everglades Department and other Broward County agencies.
Pursuant to Section 1-81.3(e) of the County Business Opportunity Act of 2012, when a CBE reserve is established, CBEs and non-CBEs may respond to the solicitation. If no CBE firm is available to perform the reserved work, a non-CBE firm may be awarded the contract. The solicitation yielded responses from two non-CBE vendors. No CBE vendors responded to the solicitation.
In an effort to encourage participation by potential CBE bidders, the solicitation provided for reduced bonding in the amount of $200,000 with the provision that if the ordered amount of the contract exceeds the amount of the payment and performance bond, including completed or in progress work orders, the contractor will be required to provide an increased payment and performance bond equal to 100% of the amount of current and future orders. This requirement shall also apply to any alternate forms of security provided by the contractor. The contract administrator will monitor ordered amounts and notify the contractor to increase bonding prior to exceeding the amount of the reduced payment and performance bond of the awarded contract.
The procurement carries a $200,000 performance and payment guaranty. The Purchasing Division confirmed with the surety company that Advanced Roofing, Inc. has the capacity to obtain the minimum required guaranty.
The allowances in this contract, in the annual not-to-exceed amount of $20,000, include: $10,000 for non-County agency permits and fees, and $10,000 for parts to cover the cost of materials that are not covered by existing bid items, but may be necessary to successfully complete the required repair or replacement.
Expenditures under the allowances must be pre-approved by the contract administrator prior to purchase and will be reimbursed at the contractor's actual incurred cost, without mark-up (Exhibit 1).
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program. Advanced Roofing, Inc. agrees to be bound to the contractual obligations of the Workforce Investment Program.
The Port Everglades Department has reviewed the bid submitted by Advanced Roofing, Inc. and concurs with the recommendation for award (Exhibit 3). Five vendor performance evaluations were completed for Advanced Roofing, Inc.; the firm has an overall rating of 3.98 out of a possible 5.0. Copies of the vendor's performance evaluations are available upon request.
The Purchasing Division researched the prices submitted by the recommended bidder, Advanced Roofing, Inc., and determined that the prices submitted are fair and reasonable in comparison to the previous Broward County contract and relevant price indices (Exhibit 4).
There was no protest or appeal filed regarding this procurement.
The solicitation posted on February 16, 2018 and opened on March 16, 2018; two bids were received with no declinations (Exhibit 1).
