Requested Action
MOTION TO ADOPT Resolution No. 2018-225 of the Board of County Commissioners of Broward County, Florida, providing for a referendum election to be held on November 6, 2018, to determine whether the Charter of Broward County shall be amended as proposed by the Charter Review Commission ("CRC"); providing for notice of the referendum election; providing for titles and wording of the ballot measures; providing for canvassing of the election results; providing for inclusion in the Charter of Broward County upon approval of ballot measures by a majority of the electors voting; authorizing the County Attorney to conform the voter-approved Charter amendments for codification purposes; providing for the delivery of a certified copy of this Resolution to the Supervisor of Elections by June 18, 2018; and providing for severability and an effective date.

ACTION:  (T-2:15 PM)  Approved, as amended with Yellow-Sheeted Additional Material, dated May 8, 2018, submitted at the request of the Office of the County Attorney.  (Refer to minutes for full discussion.)

Section 6.02 of the Charter requires the Board to place the CRC's proposed Charter amendments on the General Election ballot.

Summary Explanation/Background
The CRC met from August 21, 2015, through April 2, 2018.  The CRC also conducted five public hearings on proposed Charter amendments.  Ultimately, the CRC, by the required two-thirds vote, approved 11 measures for placement on the November 6, 2018, ballot.  These 11 ballot measures are as follows (listed in the order in which the CRC wishes for them to appear on the ballot):
 
CRC Resolution No. 2018-010, which would adopt fair districting standards to County Commission redistricting;

CRC Resolution No. 2018-011, which would, among other things, require the Board to retain a four-year Florida college or university to identify and designate nine single-member districts in an open and transparent process;
 
CRC Resolution No. 2018-007, which would establish and address the Broward County Affordable Housing Trust Fund;
 
CRC Resolution No. 2018-002, which would provide discretion (instead of a mandate) for the Inspector General to commence investigations;
 
CRC Resolution No. 2018-003, which would require the County Land Use Plan to include the Broward County Zoning Glossary, and which would provide that the Broward County Planning Council shall hold no less than one (1) public hearing prior to consideration of a proposed land use plan or plan amendment;
 
CRC Resolution No. 2018-004, which would provide for alternate members to be appointed to each of the Central Examining Boards;
 
CRC Resolution No. 2018-005, which would address the required quorum for the Board of Rules and Appeals;
 
CRC Resolution No. 2018-006, which would generally require that the County and municipalities post online notices, agendas, and backup materials at least forty-eight (48) hours prior to the scheduled meeting;
 
CRC Resolution No. 2018-008, which would change the composition of the board that nominates the Broward County Auditor;
 
CRC Resolution No. 2018-012, which would change the composition of the Selection-Oversight Committee for the Inspector General; and
 
CRC Resolution No. 2018-013, which would delete certain unnecessary charter references.
 
The ballot language for each of these measures, including the financial impact statements prepared by the Broward County Auditor, is stated in Exhibit 1. The full text of the proposed amended Charter language is stated in the CRC resolutions that are included within Exhibit 1.
