On September 14, 2017, the Board of County Commissioners ("Board") enacted Ordinance No. 2017-29, creating an MMAB to serve in an advisory capacity to the Board on all matters related to medical marijuana. One of the membership categories for the MMAB is a representative from the State Department of Health, Broward County ("DOH").
The DOH has informed Broward County that, as the administrator and enforcer of Section 381.986, Florida Statutes, related to medical marijuana, an appointment to the MMAB would constitute a conflict. The proposed motion would direct the Office of the County Attorney to draft an Ordinance replacing the DOH representative on the MMAB with a "qualified physician" with experience in ordering medical marijuana for the treatment of "qualified patients," as those terms are defined in Section 381.986, Florida Statutes.
