THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action provides for the approval of a Terminal Building Lease Agreement ("TBLA") with Caribbean to permit the use of a portion of the Airport for lease and use.
On May 7, 2013 (Item No. 2), the Board approved a Terminal Building Lease Agreement between Broward County and Caribbean with a termination date of May 20, 2018. Caribbean is a company organized and existing under the laws of the country of Trinidad & Tobago and legally authorized to do business in the State of Florida. Caribbean operate flights from FLL to various locations throughout the Caribbean Islands on a daily basis.
The proposed TBLA allows Caribbean to lease 732 square feet of Airline Ticket Office space (Type 1) in Terminal 4, departure level, and 260 square feet of Operations space in Terminal 4, Concourse G, ramp level at FLL. The TBLA shall commence on May 21, 2018, and shall terminate five years thereafter on May 20, 2023. The TBLA may be terminated at any time by the Board, the CEO/Director of Aviation or Caribbean, with or without cause, upon 30 calendar days' prior written notice to the other party.
Caribbean has posted a security deposit in the amount of $133,046, which is the estimated amount for six months' rent. Pursuant to Article 6 in the proposed TBLA, Caribbean is required to post a security deposit based on three months' rent, and if determined by the Broward County Aviation Department ("BCAD"), the security deposit amount required may be increased. Due to their late payment history with the existing Terminal Building Lease Agreement and the Field Usage Agreement and pursuant to Article 6 of the proposed TBLA, BCAD staff has determined that it is appropriate to maintain Caribbean's security deposit equivalent to six months of rent.
The amounts referenced in this agenda has been rounded to the nearest whole dollar. Caribbean's payments will be based on the actual amount payable under the proposed TBLA. The Agreement Summary Sheet reflects the estimated amount payable.
The proposed TBLA has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
