Requested Action
MOTION TO AWARD open-end contract to low responsive, responsible bidder, Eastern Elevator Service, Inc., for Elevator and Escalator Maintenance and Repair (Group 1), Bid No. D2114263B1, for the Facilities Management Division, in the initial two-year estimated amount of $852,100, including allowances in the estimated amount of $120,000, and authorize the Director of Purchasing to renew the contract for three additional one-year periods, for a potential five-year estimated amount of $2,130,250. The initial contract period begins on May 1, 2018 and terminates two years from that date, contingent upon receipt and approval of performance and payment guaranty.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.
What Action Accomplishes
Provides elevator and escalator maintenance and repair services for the Main Courthouse, Main Library, Governmental Center, Public Safety Building, Governmental Center West, South Regional Courthouse, Emergency Operations Center, and various other County offices.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development did not assign County Business Enterprise (CBE) goals for this project (Exhibit 2).

The purpose of this contract is to provide complete mechanical maintenance service, preventive maintenance, emergency service and replacement of worn or defective parts and devices for elevators located at various locations within Broward County.

The procurement carries a 50% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Eastern Elevator Service, Inc. has the capacity to obtain the required guaranty.

The allowance item included in this contract is for parts, materials, and miscellaneous items, in the initial two-year amount of $120,000 for Group 1. The contract administrator must approve expenditures under these allowance items, and Broward County shall reimburse allowances at the contractor's actual incurred cost without mark-up (Exhibit 1).

In accordance with the Broward County Living Wage Ordinance, Section 26-101 (i), these are covered services. Eastern Elevator Service, Inc. agrees to be bound to the contractual obligations of the Living Wage Ordinance.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program.  Eastern Elevator Service, Inc. agrees to be bound to the contractual obligations of the Workforce Investment Program.

The Director of Purchasing determined the low bidder for Group 1, Xpert Elevator Services, Inc., to be non-responsive to the bid requirements due to this bidder not submitting a bid bond as required in the solicitation. 

The Facilities Management Division reviewed the bid submitted by Eastern Elevator Service, Inc. and concurs with this award recommendation (Exhibit 3). There are no final vendor performance evaluations completed for Eastern Elevator Service, Inc. However, Eastern Elevator Services Inc. was awarded a contract on October 20, 2017 by the Director of Purchasing, and an interim Vendor Performance Evaluation has been completed by Facilities Management Division which yielded an overall score of 4.5 out of a possible 5 (Exhibit 6, page 9 of 16).

The Recommendation For Award posted on the Purchasing Division website from November 15, 2017 through November 21, 2017.

On November 21, 2017, Shutts & Bowen LLP filed a timely protest on behalf of thyssenkrupp Elevator Corporation (Exhibit 5).

On March 20, 2018, the Director of Purchasing issued a response denying the protest. The thyssenkrupp Elevator Corporation did not file an appeal for a formal hearing of its protest denial (Exhibit 6).

The recommended bidder, Eastern Elevator Service, Inc. submitted prices determined to be fair and reasonable in comparison to the previous Broward County contract and other governmental contracts (Exhibit 4).

The bid posted on June 26, 2017 and opened on August 9, 2017; four bids were received with no declinations (Exhibit 1).
 
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

Expenditures to Date (Group 1): $859,085.  Interim Contract Term (EZ05380X2): November 1, 2017 to January 31, 2018. Expenditures to Date (Group 1): $146,437. Interim Contract Term (EZ05380X3): February 1, 2018 to April 30, 2018. Expenditures to Date (Group 1): $196,497. Total Expenditures to Date: $8,639,368.
