MOTION TO APPROVE Addendum to the Collective Bargaining Agreement between Broward County and the American Federation of State, County, and Municipal Employees (AFSCME) - Local 2200, representing the County’s Port Everglades Department maintenance employees, as a result of a reopener for Fiscal Year 2016/2017; delegate authority to the Acting Human Resources Director to execute the Letter of Understanding; and to authorize the Mayor to execute the Agreement.

Why Action is Necessary
Chapter 447, Florida Statutes, requires that collective bargaining agreements be ratified by the governing body of the Agency, as well as by the Labor Union.

This action resolves collective bargaining with the County’s American Federation of State, County, and Municipal Employees - Local 2200, Port Everglades Maintenance Unit, and establishes labor stability through September 30, 2017.

Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE HUMAN RESOURCES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The American Federation of State, County, and Municipal Employees (AFSCME) represents a bargaining unit of approximately 75 maintenance employees within the Port Everglades Department (Port). The current Agreement, covering October 1, 2014 through September 30, 2017 and approved by the Board on March 28, 2014 (Item No. 34), provided reopener provisions for Fiscal Year 2016/2017. Negotiations of this reopener resulted in an Addendum to the Agreement (Addendum) for Fiscal Year 2016/2017 and resolves the pending impasse with this unit.

Exhibit 3 summarizes the changes to the Agreement for Fiscal Year 2016/2017. The Addendum provides the inclusion of the revised job classification titles and an updated wage and pay plan governing all employed in classifications included in the bargaining unit. Any current bargaining unit member, who is not on step in the new step plan, will be adjusted upward to the nearest step within range. For Fiscal Year 2016/2017, the Addendum provides a one-step increase within range, effective October 9, 2016, for those employees, who on their most recent annual performance review, received a rating of “Meets Overall Expectations” or greater. Also, for Fiscal Year 2016/2017, effective October 9, 2016, employees at or above the top of their pay range, who on their most recent annual performance evaluation received a “Meets Overall Expectations” or greater, will receive a one-time 3% increase to base.

In addition, there are a variety of administrative and operational changes in the Addendum, including the inclusion of the Maintenance Mechanic job classification in the list of classifications eligible to receive a 5% pay differential, the change in overtime increments from one-hour increments to 15-minute increments, the authority of the County Administrator to adjust the pay grades upward based on market review outside of the bargaining process, revision of the overtime language to be consistent with Fair Labor Standards Act (FLSA) provisions, and the inclusion of a new Standby provision in order to provide coverage for services during off-duty hours.

This Addendum also includes a Letter of Understanding - Job Classification Review, to review certain job classifications that were previously held at the Port, to determine the appropriateness of the current classification.

The Addendum was successfully ratified by the Union on Monday, April 2, 2018, and is being presented with staff’s recommendation for approval by the Board.

Fiscal Impact
Fiscal Impact/Cost Summary:
The value of the salary increase for all qualifying employees totals $72,360, exclusive of FICA and retirement contribution. Funds for this increase are available within the Fiscal Year 2018 Adopted Budget.
