A. MOTION TO APPROVE Amendment No. 1 to the Transportation Regional Incentive Program (TRIP) Agreement between the Florida Department of Transportation (FDOT) and Broward County for the McIntosh Road Additional Lane Project at Port Everglades, extending the term of the agreement by an additional 12 months from June 30, 2018, to June 30, 2019, effective upon execution by FDOT; and authorize the Mayor and Clerk to execute same.

MOTION TO DELEGATE authority to the Port Everglades Chief Executive/Port Director to approve any future amendments or supplements to the subject agreement, limited to extending the term or changes to the scope of services and deliverables, and provided that the amendment or supplement does not require additional funding by Broward County.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

This item supports the Broward County Board of County Commissioners' (Board) Value of "Ensuring economic opportunities for all people and businesses in Broward" and Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs."

The original Transportation Regional Incentive Program (TRIP) Agreement between Broward County and FDOT (Financial Project No. 438070-1-94-01; Contract No. G0G33) provided FDOT funding of $780,000 in Fiscal Year 2016/2017 and required 50% matching funds of $780,000 to be provided by Broward County for the design and construction of an additional lane at the McIntosh Road security checkpoint in Port Everglades. The original TRIP Agreement was approved by the Board on September 15, 2016 (Item No. 12). The TRIP Agreement term ends on June 30, 2018.

The current schedule anticipates construction of this project commencing in summer 2018. Therefore, Port Everglades is requesting approval of a 12-month extension in order to provide sufficient time to complete the project and draw down the TRIP funds. Amendment No. 1 extends the term of the original TRIP Agreement from June 30, 2018, to June 30, 2019, with no other changes.

The agenda item also would delegate authority to the Port Everglades Chief Executive/Port Director to approve any future amendments or supplements to extend the period of performance, or changes to the scope of services and deliverables related to the project, provided that no additional County funding is required. This will allow for changes to these elements without Board approval, allowing for more timely action on project revisions and reduced administrative workload.

The project is located in the Southport area of Port Everglades (see Exhibit 3). The existing lanes at the McIntosh Road security checkpoint would remain, but will be expanded to the west by adding another lane within the existing McIntosh Road Right of Way to increase the capacity for exiting vehicle traffic by one lane while maintaining the current number of inbound lanes. The addition of another lane at the McIntosh Road security checkpoint is one of the projects developed as part of the overall infrastructure needs identified in the Port Everglades Master/Vision Plan adopted by the Board on June 24, 2014 (Item No. 59).

This Amendment is written in the FDOT standard form and has been approved as to form by the County Attorney’s Office. As is normal, FDOT will execute this Amendment after the County’s approval and execution.
