MOTION TO APPROVE Drainage Maintenance and Access Agreement between Broward County, the City of Lauderhill and WE Florida Financial for the Lauderhill Towne Centre Library, located at 6399 West Oakland Park Boulevard and other adjacent properties in Lauderhill for the purpose of maintaining the storm water drainage system, in substantially the form attached; and authorize the Mayor and Clerk to execute same. Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT RECOMMEND APPROVAL

The Lauderhill Towne Centre Library is located at 6399 West Oakland Park Boulevard in Lauderhill and identified by Folio Number 4941-23-22-0010.  The property was acquired from the City of Lauderhill (City) in 2008 pursuant to the Agreement for Conveyance of Real Property for Public Library and Design and Construction of a Library Facility, which was approved by the Board of County Commissioners on August 13, 2002 (Agenda Item No. 5). The City of Lauderhill continued to own the adjacent property east of the library. Recently, the City sold a portion of the City-owned property to WE Florida Financial.

The City is responsible for the storm water drainage system, which serves the County's library and properties now owned by the City and WE Florida Financial, pursuant to a Surface Water Management License and Environmental Resource Standard General Permit (Permits). In order for WE Florida Financial to develop its site, the County's Environmental Engineering and Permitting Division requires an agreement amongst the County, City and WE Florida Financial for the management of the storm water drainage system. The City shall continue to be the licensee and operating entity for the Permits and shall obtain all required renewals of the Permits. The City shall maintain the storm water drainage system on the three parcels, including, without limitation, paving, parking and access, drainage lines, exfiltration trenches, other drainage facilities, and retention areas. The County and WE Financial acknowledge and grant the City the right to enter the County property and the WE Financial property respectively, to maintain and operate the storm water drainage system covered by the permit.  

Staff is requesting the Board of County Commissioners approve the proposed agreement in substantially the form attached pending approval of same from the City of Lauderhill, which is scheduled to consider the item on March 26, 2018. Signature pages for the City and WE Florida Financial will be substituted upon receipt.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
