MOTION TO DECLARE Surplus to the County's needs real property comprised of approximately 3,049 square feet of residentially zoned land located at South Cypress Road in Pompano Beach; and authorize the Real Property Section to manage the sale of the subject property in accordance with Florida Statutes, Section 125.35(2). (Commission District 4)

(Per the Tuesday Morning Memorandum, at the request of the Office of the County Attorney, please add the following at the end of the motion statement: “And find that the subject property is valued at $15,000 or less and is of use to only one or more adjacent property owners due to its size, shape, location, and value; and authorize staff to send notice to adjacent property owners of the County’s intent to sell this surplus property.”)

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The vacant land, comprised of two parcels, is identified by Folio Number 4942-02-06-0240, approximately 3,049 square feet, and located at South Cypress Road in Pompano Beach. The parcels are zoned RM-20, Multiple Family Residence under Pompano Beach zoning codes. The Broward County Property Appraiser assesses the parcels' value at $20.

The County acquired these parcels on October 1, 1951 from Everglades Drainage District by Quit Claim Deed as recorded in Deed Book 749, Page 172 of the Public Records of Broward County. All applicable Broward County agencies were solicited for potential County use of these parcels or rights therein and no current or future use was identified for these parcels.
 
Pursuant to Florida Statutes, Section 125.35(2), "...when the Board of County Commissioners finds that the value of a parcel of real property is $15,000 or less...as determined by the County Property Appraiser and when, due to the size, shape, location and value of the parcel, it is determined by the Board that the parcel is of use only to one or more adjacent property owners, the Board may effect a private sale of the parcel", by sending notice to the adjacent property owners and accepting sealed bids from such property owners. The Board of County Commissioners may convey the property to the highest bidder or may reject all offers.
