THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action will amend the Agreement to Increase the Contract Price Element and County’s FIS Contingency to complete construction of the North Baggage Hall in T4.
This item supports the Board’s Value for "Ensuring economic opportunities for all people and businesses in Broward County," its Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs" and its Objective to increase passenger facilities in T4 at FLL.
The Office of Economic and Small Business Development ("OESBD") established a County Business Enterprise ("CBE") goal of 28% for this project. Cummings-Balfour Beatty, A Joint Venture ("CBB") committed to 28.01% CBE participation. To date, CBB has been paid $157,265,947 and has paid CBE firms $46,227,245, for 29.39% participation (Exhibit 3).
On September 28, 2010 (Item No. 29), the Board approved the award of the Agreement between Broward County and CBB for Construction Manager at Risk Services for the construction of the T4 Gate Replacement - Western Expansion at FLL, with a deliberately phased approach. The original phase of the Agreement (Phase 1) was in the amount of $1,939,190 for preconstruction services associated fees, and early work contingencies only, to address predesign work. An Agreement History is included in Exhibit 4.
On December 6, 2016 (Item No. 5), the Board approved the Fifth Amendment to the Agreement in the amount of $12,000,000, to increase the Contract Price Element, County’s FIS Contingency, for deliberately phased construction of the North Baggage Hall with Interim and Secondary Processing Area, for a total revised Agreement amount of $176,502,990.
The proposed Sixth Amendment increases the Contract Price Element County’s FIS Contingency to complete construction of the North Baggage Hall. The additional funding will provide for pending and future changes and delay-related costs. Changes to this project have occurred for various reasons including Owner/Other agency requests, field conditions, and potential Architect/Engineer (“A/E”) error and omissions. Examples of such changes include, but are not limited to extended General Conditions, replacement of the Owner Controlled Insurance Program, baggage handling system conflicts with new and existing utilities, procurement of x-ray inspection systems required by Transportation Security Administration, cooling systems in the Customs and Border Patrol telecommunications room, and additional upgrades to the Recheck Facility.
Delay-related costs are primarily attributed to the constricted area between the FIS expansion and the adjoining T4 Eastern Expansion (“T4E”) project. The close proximity required detailed coordination of sequential work activities, including a Stop Work Order which delayed the FIS expansion by three and a half months to facilitate foundation installation, underground utilities and installation of exterior pre-cast panels for the T4E project. In addition, there were design changes that resulted in delays; some of these changes have been identified as potential A/E errors.
The North Baggage Hall opened to passengers in February 2018; construction of the remaining work is anticipated to be completed by late Spring 2018.
Approval of the Sixth Amendment increases the Agreement amount by $5,000,000, for a revised total Agreement amount of $181,502,990. The requested increase is within the overall budget for the T4 project.
The proposed Sixth Amendment has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the maximum amount payable under this Agreement. The Agreement Summary Sheet reflects the actual amount of the award.
