Requested Action
MOTION TO AWARD open-end contract to low bidder, Envirowaste Services Group, Inc., for Clean, Inspect and Repair Drainage Facilities, Bid No. PNC2115402B1, for Water and Wastewater Services, in the annual estimated amount of $702,100, which includes allowances in the amount of $75,000 and authorize the Director of Purchasing to renew the contract for two one-year periods, for a three-year potential estimated amount of $2,106,300. The initial contract period begins on the date of award and terminates one year from that date, contingent upon receipt of insurance/payment performance guaranty.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Provides an open-end contract for the cleaning, inspection and repair of drainage facilities throughout Broward County.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 25% for this contract. Envirowaste Services Group, Inc. committed to 25% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 3).

The purpose of this contract is for the cleaning, inspecting and repair of Broward County drainage culverts and ancillary facilities. This includes restoration and maintenance of canals within Cocomar Water Control District, Water Control District 2, Water Control District 3, Water Control District 4 and other areas managed by the County. 

This procurement carries a 25% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Envirowaste Services Group, Inc. has the capacity to obtain the required guaranty.

The allowances incorporated in this contract, in the total amount of $75,000, include: $50,000 for parts, materials and specialized equipment, $5,000 for permit and dump fees and $20,000 for specialty subcontractor services. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor’s actual cost without mark-up.

In accordance with the Broward County Living Wage Ordinance No. 2008-45, as amended, Section 26-101 (i), these are covered services. Envirowaste Services Group, Inc. has agreed to be bound to the contractual obligations of the Living Wage Ordinance.

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Envirowaste Services Group, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.

The low bidder, Envirowaste Services Group, Inc., is a non-local business. Intercounty Engineering, Inc., the second bidder, is a local business, and its bid amount was within 10% of the non-local bidder's bid amount. Therefore, in accordance with the Local Preference Ordinance, the Best and Final Offer (BAFO) process was extended to Envirowaste Services Group, Inc. (a non-local business) and Intercounty Engineering, Inc. No bids were received in response to the BAFO, and the award is being recommended to the low bidder, Envirowaste Services Group, Inc. (Exhibit 2).

Water and Wastewater Services reviewed the bid submitted by Envirowaste Services Group, Inc. and concurs with the recommendation for award (Exhibit 4). No vendor performance evaluations were completed for Envirowaste Services Group, Inc.

The purchasing agent has researched the prices submitted by the recommended bidder, Envirowaste Services Group, Inc., and has determined that the prices submitted are fair, reasonable and aligned with market analysis for the industry (Exhibit 5).

There was no protest or appeal filed regarding this procurement.

Incumbent: Shenandoah General Construction Company, Contract Number Y1284708B1, Clean, Inspect and Repair Drainage Facilities; Contract Term: January 27, 2015 to January 26, 2018, expenditures to-date: $1,484,835.

On January 30, 2018, the Director of Purchasing approved the 90-day extension for Contract Number Y1284708B1 with Shenandoah General Construction Company. The contract expires on April 26, 2018.

The bid posted on November 20, 2017 and opened on December 27, 2017; three bids were received with one declination (Exhibit 1).
