MOTION TO DIRECT Office of the County Attorney to analyze the limitations on local government regulation of firearms and ammunition for areas of possible action by the Board and report to the Board on local government regulation or licensing requirements that may be permissibly enacted under existing Florida law. (Vice-Mayor Bogen)

VOTE: 8-0. Commissioners Holness and Geller voted in the affirmative telephonically.  Commissioner LaMarca was inaudible.

Board direction is required to direct the Office of the County Attorney to analyze permissible regulation.

Summary Explanation/Background
The tragedy at Marjory Stoneman Douglas High School emphasizes again the need for better regulation of access to firearms and ammunition. The Florida legislature has preempted most of the field regarding regulation of firearms and ammunition; however, the Florida Constitution authorizes certain local government regulation such as requiring criminal history records checks and waiting periods in certain circumstances. Broward County has already enacted regulation to require criminal history records checks and waiting periods in certain circumstances (Broward County Code of Ordinances Section 18-96 and Section 18-97).
 
This agenda item directs the Office of the County Attorney to analyze the current limitations on local government regulation and report back to the Board before the next Commission meeting on areas of possible action by this Board to regulate access to firearms and regulation to the greatest extent permissible under existing law.
