MOTION TO APPROVE shell Interlocal Agreement between Broward County and government entities for use of Temporary Debris Management Sites and related final disposal services; and grant authority to the County Administrator or designee to execute same on behalf of Broward County.

Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES RECOMMENDS APPROVAL.

Broward County operates Temporary Debris Management Sites (TDMS) to handle debris processing and related disposal services in the aftermath of a debris-producing event or disaster. Currently, 17 government entities have entered into an Interlocal Agreement with Broward County to utilize these services. The existing Interlocal Agreements expired at the end of the 2017 hurricane season.

Approval of the new shell Interlocal Agreement will allow Broward County government entities to continue to utilize these services, if they so desire. In order to allow for proper and necessary planning, a government entity must execute the Interlocal Agreement by March 31st of the year that it desires to begin utilizing Broward County’s services. Upon execution, the Interlocal Agreement will become effective and terminate on November 30, 2022. Upon mutual written consent, the Interlocal Agreement can be extended for two additional five-year terms through the County Contract Administrator.

Broward County is solely responsible for determining the number and locations of the TDMS to be opened after a debris-producing event. The determination will be based on the locations of government entities that have agreements with the County, the estimated amount of debris, and the resources available for operating the TDMS. The number of TDMS may vary for each event. The Interlocal Agreement does not obligate a government entity to deliver any or all of its debris to Broward County’s TDMS.

Broward County will invoice each of the Broward County government entities that utilize these services for a proportionate share of the total cost of services based on the volume of debris delivered by or on behalf of the government entity to the TDMS.

The new shell Interlocal Agreement is similar to the expiring agreement. It delineates the responsibilities of each party for use of the County’s TDMS and related disposal services. Broward County will invoice the participating government entities directly for services rendered. Each government entity is responsible for paying Broward County and for handling its own reimbursement claims to FEMA.

The agreement has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.

Fiscal Impact/Cost Summary:
There is no fiscal impact to the County. Broward County will invoice each government entity for its proportionate share of services provided.
