MOTION TO AUTHORIZE County Administrator to approve and execute all modifications to Agreement 17EA-0F-11-16-01-004 (Agreement) between Broward County and the State of Florida, Department of Economic Opportunity (DEO) for Low Income Home Energy Assistance Program (LIHEAP), and any replacement agreement including amendments, subject to approval as to form by the Office of the County Attorney; and authorizing the County Administrator to continue to take all necessary administrative and budgetary actions related to the agreement(s).

VOTE: 7-0.  Commissioner Holness appeared telephonically and voted in the affirmative.  Commissioners Geller and LaMarca appeared telephonically but were inaudible during the vote.
Why Action is Necessary
Agreements and amendments with external agencies require Board approval. Modifications to Agreement 17EA-0F-11-16-01-004 covered by this action would exceed the dollar amount of the authority previously delegated to the County Administrator.
What Action Accomplishes
This action allows the existing LIHEAP Agreement to operate through September 30, 2020, at approximately the same level of service as originally provided in the agreement, allowing the County to continue to provide home energy assistance to low-income residents.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE FAMILY SUCCESS ADMINISTRATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Value for "Approaching human services collaboratively and compassionately with special emphasis on the most vulnerable," and the Goal to "Effectively advocate for and acquire municipal, state and federal financial support that equitably address health and human services needs of the entire community, through a truly coordinated system of care." Funding will provide energy assistance payments to approximately 7,000 unduplicated households for each 12-month period.

The Governor of the State of Florida designated the Broward County Board of County Commissioners as the Community Action Agency (CAA) for Broward County. For more than 20 years, this designation allowed the County to receive LIHEAP funding to assist more than 200,000 low income households in Broward County which are at or below 150% of poverty level (as of February 2018 $37,650 annual income for a family of four).

The Board approved Agreement 17EA-0F-11-16-01-004 on April 25, 2017, providing $4,215,024 for the County's LIHEAP from April 1, 2017 through March 31, 2018. The Board simultaneously authorized the County Administrator to approve modifications up to $5,000,000. Pursuant to that authority, the County Administrator approved Modification 1, which increased the dollar amount to $4,757,528. DEO now proposes Modification 2, which not only increases the dollar amount to $4,821,353, but also extends the end date of the agreement through September 30, 2020.

While Modification 2 will extend the end date of the Agreement through September 30, 2020, the current funding level satisfies the operational needs of LIHEAP only through March 2018. Staff anticipates that DEO will promulgate subsequent modifications to provide additional LIHEAP funding for the period starting April 2018 for a certain period or through the extended term of the Agreement. The modifications and any replacement agreement, including amendments, will require processing to secure the funds for new funding periods. 

The modifications, replacement agreement and amendments to any such agreements will be in DEO's format and will be reviewed and approved by Risk Management Division for insurance requirements. The modifications and any replacement agreement and amendments to such agreement will also be reviewed and approved as to form by the Office of the County Attorney prior to approval and execution by the County Administrator.
