A. MOTION TO WAIVE requirement in Bid No. X2114362B1 to provide the State of Florida registration as a Broward County Fence Erection Contractor.  

ACTION:  (T-10:50 AM)  Approved.

B. MOTION TO AWARD open-end contract to low bidder, Bauer Construction Corp., for Fencing - New, Repair and Replacement Services, Bid No. X2114362B1, for the Broward County Port Everglades Department and other Broward County agencies, in the annual estimated amount of $963,466, which includes allowances in the amount of $6,000, and authorize the Director of Purchasing to renew the contract for two one-year periods for a maximum three-year potential estimated amount of $2,890,398. The initial contract period begins on the date of award and terminates one year from that date.

Why Action is Necessary

A. In accordance with the Broward County Procurement Code, Section 21.30.f.1(c), the Board may waive a minor or non-substantive lack of conformity in the submission of bid requirements considered to be a technicality or irregularity.

B. In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

The Office of Economic and Small Business Development (OESBD) designated this a reserved project for County Business Enterprise (CBE) firms. The OESBD determined that Bauer Construction Corp. (Bauer) meets the eligibility criteria of the CBE Reserve Program (Exhibit 2).

The Director of Purchasing recommends waiving, as a non-substantive irregularity, the requirement to provide the State of Florida registration as a Broward County Fence Erection Contractor. After bids were received and during the review of the apparent low bidder’s licenses, staff searched the State of Florida’s website and found that there was no license type for a Fence Erection Contractor. Staff also contacted the State of Florida and was informed that registration was only available for existing categories regulated by the State of Florida, and fencing was not one of them. Thus, the Broward County Fence Erection Contractor’s license does not have to be registered with the State of Florida as required in the solicitation. Bauer’s Broward County Fence Erection Contractor’s license is valid and meets the licensing requirements for the scope of services for this contract.

The purpose of this contract is to provide fencing services, which include the installation of new fences and repair or replacement of existing fences at Broward County Port Everglades and various other locations throughout Broward County on an as needed basis. The scope of work includes all services and materials required to effect the installation of new fencing, repair and replacement of existing fencing. The fencing services will consist of all elements including gates, posts, fabric, bracing, tension wires, barbed wire supporting arms and barbed wire, miscellaneous fencing, gate repairs including straightening poles, adjusting gates, repair or replacement of rollers, fabric or barb wire and fence anchorage. The contract also provides for removal and proper disposal of existing fencing to an approved location or licensed landfill facility.

The allowance items included in this contract, in the total annual estimated amount of $6,000 are for project-specific requirements for parts and materials and non-Broward County permits and fees necessary to complete a project. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor's actual incurred cost, without mark-up (Exhibit 1).

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program. Bauer has agreed to be bound to the contractual obligations of the Workforce Investment Program.

The Port Everglades Department has reviewed the bid submitted by Bauer and concurs with the recommendation for award (Exhibit 3).

Twelve vendor performance evaluations have been completed for Bauer Construction Corp. with an overall rating of 4.40 out of a possible rating of 5.0. Copies of the vendor's performance evaluations are available upon request.

There was no protest or appeal filed regarding this procurement.

The bid posted on November 9, 2017 and opened on December 15, 2017; three bids were received with no declinations (Exhibit 1).

The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
