Requested Action
MOTION TO DIRECT Office of the County Attorney to draft a Resolution or Ordinance (as required), to work with the Office of the County Administrator to draft ballot language, and to draft any other documents necessary to, if so desired by the Board, levy a 1% Charter County and Regional Transportation System Sales Surtax for a period of 30 years, subject to approval by a majority of the electorate during the General Election on November 6, 2018. (Mayor Furr)

ACTION:  (T-11:44 AM)  Approved, as amended, with direction to the County Attorney's Office to draft ballot language and a proposed Ordinance consistent with the Board's comments today, as well consistent with the Board's comments at the Board's Retreat.  (Refer to minutes for full discussion.)  (See Yellow-Sheeted Additional Material, dated March 20, 2018, submitted at the request of Commissioner Ryan.)

Summary Explanation/Background
Section 212.055(1), Florida Statutes, provides for the levy of a Transportation Surtax, at a rate of up to 1%, subject to approval by a majority vote of the electorate. The proceeds of the Transportation Surtax may only be expended for transportation and transit purposes authorized in Section 212.055(1)(d), Florida Statutes.

At the March 12th Broward County Board of County Commissioners Board Retreat, the Board was shown a presentation on the Local Option Transportation Plan, featuring a proposed plan for Regional Mobility and Transportation Enhancements (Exhibit 2). Based on Board discussion, there seems to be a preliminary consensus to pursue the levy of a Transportation Surtax for the 2018 ballot. This agenda item directs the County Attorney and County Administration to draft language for the ballot item in accordance with this discussion.

Attached hereto are two ballot measures. The first was the language that appeared on the November 2016 ballot. The second was the language drafted prior to the decision to link the transportation and infrastructure surtax ballot measures. Because a ballot summary may not exceed 75 words, and linkage language was inserted into the ballot measure, some of the descriptive language contained in the second measure was deleted from the language that appeared on the ballot.
