MOTION TO DISCUSS and provide direction to the Office of the County Attorney regarding the revised conceptual settlement proposal by the City of Pompano Beach and the Pompano Beach Community Redevelopment Agency in the matter of Pompano Beach Community Redevelopment Agency, et al. v. Broward County, 17th Judicial Circuit Court Case No. 14-009654 (18).

ACTION:  (T-11:30 AM)  Following discussion, the Board provided direction to the County Attorney's Office to submit the County Administrator's current conceptual counterproposal to the City of Pompano Beach and the Pompano Beach Community Redevelopment Agency.  (Refer to minutes for full discussion.)  (See Yellow-Sheeted Additional Material, dated March 20, 2018, submitted at the request of County Administration.)

VOTE:  9-0.

Board action is required to formally respond to a conceptual settlement proposal.

Allows the Board to discuss the conceptual proposal and provide direction to the County Attorney.

On February 27, 2018, the City of Pompano Beach approved the presentation to the County of a "Conceptual Counter-Counterproposal" (Exhibit 1 hereto) that contains proposed terms for settling the pending litigation. The Office of the County Attorney seeks formal direction from the Board regarding a response to the City's current proposal. The Office does not believe a shade meeting is necessary to develop a formal response to the conceptual proposal.

We are prepared to discuss in individual briefings the details of and our recommendations regarding the current settlement proposal. If, as a result of such briefings, we determine that a shade meeting would be beneficial, we will withdraw this item and request that a shade meeting occur on April 10, 2018.
