On February 27, 2018, the Broward County Board of County Commissioners approved a shell Interlocal Agreement (the "ILA") between Broward County and government entities for the use of Temporary Debris Management Sites ("TDMSs") and related final disposal services. The County operates TDMSs to handle debris processing and related disposal services in the aftermath of a debris-producing event or disaster.
Section 2.6 of the ILA requires approval of the ILA on or before March 31, 2018, for municipalities to be able to take advantage of the services for the upcoming hurricane season. Several government entities have indicated some difficulty in getting the required approvals by that date. The Alternate ILA changes the deadline for the current year to April 30th to allow the municipalities additional time. Some municipalities have also expressed concern with the language in Section 8.7 of the ILA, which relates to conflicts. The Office of the County Attorney has reviewed the language and agrees that, other than the first sentence of Section 8.7 (which remains in the Alternate ILA), the language does not add anything substantive and material to the ILA. Attached as Exhibit 1 is the Alternate ILA, showing the specific changes to the ILA in strike-through format.
The Office of the County Attorney recommends approval of the Alternate ILA. This agenda item further requests approval to allow the County Administrator in consultation with the County Attorney to make any other nonsubstantive and immaterial changes to the Alternate ILA as they deem appropriate. |
