MOTION TO ADOPT Resolution No. 2018-070 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, April 10, 2018, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
 
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO PARKS AND RECREATION; AMENDING SECTION 25½-1 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), PROVIDING FOR DEFINITIONS; CREATING SECTION 25½-13, PROVIDING FOR USE OF PARK PROPERTY TO ENGAGE IN COMMERCIAL RECREATIONAL INSTRUCTIONAL ACTIVITIES; CREATING SECTION 25½-14, ESTABLISHING A PERMITTING PROCESS TO ENGAGE IN ANY PERMITTED ACTIVITIES ON PARK PROPERTY; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meeting of October 13, 2015.
What Action Accomplishes
Amends the Code to provide regulations for commercial recreational instructional activities conducted in County parks and establishes a permitting process for activities and events within County parks and facilities that require prior authorization from the County.

Summary Explanation/Background
On October 13, 2015, the Board of County Commissioners directed that an ordinance be drafted updating Chapter 25½ of the Broward County Code of Ordinances, including the establishment of a process for regulating and restricting unauthorized commercial activities in County parks. The proposed Ordinance establishes a process for obtaining permits for conducting commercial recreational activities in County parks including, but not limited to, providing the requirements and procedures for applications for permits, permit approvals, denials, suspensions, and revocations, and appeals from any such denials, suspensions, or revocations.
