Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The 40-foot-wide easement intended for "roads, utilities and related purposes" lies within Parcel "B," Mulvey Plat No. 1, as recorded in Plat Book 106, Page 15 of the Public Records of Broward County and is located at 3401 Coral Springs Drive in Coral Springs in Section 16, Township 48 South, Range 41 East. The Folio Number affected by this proposed vacation is 4841-16-12-0010.

Vacating this easement will provide clear and unencumbered title to the property owner, 144 Coral Springs LLC.

The City of Coral Springs approved this vacation by adopting Resolution 2015-044 on September 2, 2015. The Petitioner published a Notice of Intent to vacate on September 25, 2015 and October 2, 2015.

The vacation application and fee were received and the fee was deposited by the County's Real Property Section on November 4, 2015.

Review of this application by the County Attorney's Office, applicable Broward County agencies and utility companies was completed on November 21, 2017. Broward County Traffic Engineering Division approved the vacation of the easement intended for "roads, utilities and related purposes", after a replacement utility easement was provided by the Petitioner. The replacement easement was recorded in the Public Records of Broward County on January 18, 2018, Instrument No. 114834345, resolving the issue. No other reviewing agency has indicated that the easement intended for roads, utilities and related purposes is currently used, nor is there a plan for future use. No objections to this vacation were raised by any of the reviewing agencies.

The Board of County Commissioners approved the Resolution Authorizing Public Hearing on February 27, 2018 (Item No. 9).

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
