MOTION TO APPROVE Amendment No. 1 to open-end interim contract with Schindler Elevator Corporation for Maintenance and Repair of Elevators and Escalators, Interim Contract No. Z1237002X1, based on the terms and conditions of Bid No. Z1237002B1, on a month-to-month basis not-to-exceed six months, with an effective date of March 23, 2018, for an estimated not-to-exceed contract amount of $840,000, which includes allowances in the estimated amount of $30,000, for the Aviation Department Maintenance Division.

Why Action is Necessary
In accordance with the Broward County Procurement Code Section 21.31.a.4, the Board is required to approve all awards exceeding $250,000 per annum or $400,000 for a multi-year period.
What Action Accomplishes
Provides an open-end contract for continuity of maintenance and repair services of elevators and escalators for Broward County's Fort Lauderdale-Hollywood International Airport terminals, parking garages and Rental Car Center.

Summary Explanation/Background
On September 23, 2014 (Item No. 24), the Board awarded open-end Contract No. Z1237002B1 to Schindler Elevator Corporation. The contract began on September 23, 2014 for an initial three-year period at an estimated three-year amount of $2,629,328, including parts on a pass-thru allowance in the amount of $45,000, with two one-year renewal options for a total potential five-year estimated contract amount of $4,460,518. The County did not exercise the renewal options in order to solicit a replacement contract with expanded scope adding equipment and service locations and combining requirements of this subject contract with Contract No. Z0936014B2, Elevator/Escalator Maintenance/Repair Terminal 1, which expired September 13, 2016.

On September 14, 2017, the Director of Purchasing approved the extension of Contract No. Z1237002B1 in the amount of $209,012, including $4,180.83 for parts on a pass-thru, for 90 days as provided in the Standard Bid General Terms and Conditions, Section 7. Usage for Contract No. Z1237002B1 was $2,685,715. The contract expired on December 22, 2017.

On December 20, 2017, the Director of Purchasing awarded interim Contract No. Z1237002X1 in the not-to-exceed three-month amount of $250,000, commencing on December 23, 2017 and continuing on a month-to-month basis not to exceed March 22, 2018. The Director of Purchasing, also, approved a 3% increase to unit prices for all contract items, with the exception of the pass-thru allowance line, as allowed under Section 30, Price Adjustment Clauses, of Solicitation No. Z1237002B1. Usage for Contract No. Z1237002X1 is $198,784. The contract expires on March 22, 2018.

On January 23, 2018, Solicitation No. BLD2115482B1 was advertised, and opened on February 9, 2018. County staff is currently reviewing vendor responses.

On February 22, 2018, the Aviation Department submitted its request to extend the interim contract to maintain continuity of services due to the expiration of the current interim contract on March 22, 2018 and the pending award of the replacement contract (Exhibit 1).

A new contract will not be in place prior to the expiration of Contract No. Z1237002X1. The proposed amendment to the interim contract provides for an extension of the same terms and conditions of Contract No. Z1237002B1, Maintenance and Repair of Elevators and Escalators. The County procured these services through a competitive bid process; therefore, the basis of this interim contract will be the terms and conditions of Contract No. Z1237002B1 and the approved increased prices of  interim Contract No. Z1237002X1. This will allow additional time for County staff to continue its review of responses. 

The contractor for the proposed interim contract, Schindler Elevator Corporation, has agreed to an interim contract based on the same terms and conditions as the original Contract No. Z1237002B1, which the Board approved on September 23, 2014, Agenda Item No. 24 (Exhibit 2).

Seven performance evaluations have been completed for Schindler Elevator Corporation with an average rating of 3.55 out of a possible 5.00. A copy of the vendor performance evaluations are available upon request.
