Requested Action
MOTION TO ADOPT Resolution No. 2018-075 accepting a quit claim deed from Housing Foundation of America, Inc., for real property located in the Broward Municipal Services District and approving the release of the restrictive covenants recorded on said real property; authorizing, pursuant to Sections 197.592 and 125.38, Florida Statutes, the conveyance of certain real property located in the Broward Municipal Services District and acquired by the County by virtue of delinquent taxes to Housing Foundation of America, Inc.; authorizing the Mayor or Vice-Mayor and County Administrator to execute required documents for such conveyance and release of restrictive covenants; and providing for severability and an effective date. (Commission District 9)

Why Action is Necessary
Board of County Commissioners approval is required to accept and convey County owned real property, pursuant to Florida Statutes, Sections 197.592 and 125.38, and the Broward Administrative Code, Section 6.23.
What Action Accomplishes
Four actions are accomplished 1). Acceptance of the return of vacant "Parcel A", located at 873 NW 27 Terrace, in the Broward Municipal Services District (BMSD), which was previously conveyed to Housing Foundation of America, Inc. (HFA), a nonprofit developer; 2). Release of the Restrictive Covenant of "Parcel A"; 3). Conveyance to HFA of a substitute vacant lot, "Parcel B", located at the corner of NW 7th Court and NW 28 Avenue, in the BMSD; and 4). Amendment to the Memorandum of Understanding with HFA reflecting this parcel substitution.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT/HOUSING FINANCE AND COMMUNITY REDEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This action addresses the County's value of "offering sustainable, compatible, innovative housing options for all income-levels, including integrated, permanent supportive housing", and specifically meets the established Commission goal to "increase the availability of affordable housing of all types, countywide, in every community using effective, uniform criteria, policies and strategies."
 
On March 14, 2017, the Board adopted Resolution No. 2017-085 (Item #84) conveying forty vacant lots to ten nonprofit housing development organizations, of which Housing Foundation of America, Inc., (HFA) is one, to build affordable single family homes, consisting of a minimum of 1500 square feet under air with a two car garage, for a total minimum house size of 1900 square feet. One of the lots previously conveyed to HFA, "Parcel A", is a 5,000 square foot corner lot with side yard set backs and required frontage street parking. The corner set backs and parking requirements reduce the buildable house footprint, and the County's single story minimum size home could not be constructed on "Parcel A". 

The adoption of the Resolution accepts the Quit Claim Deed of "Parcel A" previously conveyed to HFA and releases Parcel A's Restrictive Covenant; then conveys via Quit Claim Deed to HFA an alternative substitute corner lot (entitled "Parcel B"), which contains 6,000 square feet. The County's minimum home square footage and development requirements for the single family home can be developed on "Parcel B". The existing Memorandum of Understanding, an attachment to the Resolution, is amended to reflect this parcel exchange.

"Parcel A" is a marketable, buildable lot, however developing a detached single family home on "Parcel A" will require an alternative house design and floor plan.
