A. MOTION TO APPROVE sole brand, only reasonable source designation to utilize State of Florida Department of Management Services, Alternate Contract Source No. 43211500-WSCA-15-ACS, NASPO ValuePoint Cooperative Procurement Program Computer Equipment Master Agreement No. MNWNC-119 for Microsoft Surface hardware and accessories, from Microsoft pursuant to the terms of the Minnesota Contract.

B. MOTION TO APPROVE Participating Addendum, pursuant to the State of Florida Department of Management Services Agreement, between Broward County and Microsoft Corporation, for Microsoft Surface hardware and accessories for the Enterprise Technology Services Division, in the estimated amount of $2,100,000 through the duration of the agreement; and authorize the Mayor and Clerk to execute same. The Participating Addendum begins upon execution by the Board and shall continue for the duration of the State of Florida Contract No. 43211500-WSCA-15-ACS (including extension thereto), unless earlier terminated. The current term of the State of Florida Contract No. 43211500-WSCA-15-ACS is through March 31, 2020.

Why Action is Necessary
A. and B.: In accordance with the Broward County Procurement Code, Section 21.36, the Director of Purchasing may purchase directly, without bids or quotations, from General Services Administration (GSA) contracts from federal, state or local contracts if the awarding jurisdiction and/or the vendor agree to allow the County to purchase therefrom. Additionally, in accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all awards exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

This item supports the Board's value, "Consistently delivering responsive, efficient, quality services to the public and internal customers"; and its goal, "Build into every process and service effective checks and balances that do not cause inefficiency, but rather ensure consistency, continuity, and quality".

The purpose of this Participating Addendum is to provide computer hardware, including Microsoft Surface tablets and accessories.
 
On April 12, 2016 (Item No. 18), the Board approved sole brand, only one reasonable source designation to utilize State of Minnesota Cooperative Purchasing Venture (CPV), Contract No. 57647 for Microsoft Computer Equipment, Accessories, Hardware, Related Software and Services with Microsoft Corporation. The CPV contract was defined as the "Only One Reasonable Source" as this was the only direct contract between a government entity and Microsoft, which provided the deepest discount price offerings available. The State of Minnesota opted to discontinue this contract and recommend that all CPV members negotiate an agreement with Microsoft under the NASPO contract association.
 
Microsoft Surface and associated Microsoft branded products are sole branded Microsoft products. The Microsoft Surface product runs all Microsoft Applications, integrates into all available resources in the County's Enterprise network and provides the ability to work remotely and at the office. The Surface product line is solely owned by Microsoft and is not duplicated by third parties in a manner where a perfect "clone" system exists. Microsoft utilizes their chain of retail stores to provide order logistics, account management and warranty follow up.

The State of Minnesota conducted a competitive solicitation that resulted in a contract with Microsoft to provide computer equipment, including desktops, laptops, servers and storage, related peripherals and services, which contract is available to local government entities in Florida through the Participating Addendum to the NASPO ValuePoint Cooperative Procurement Program Computer Equipment Master Agreement No. MNWNC-119, Alternate Contract Source No. 43211500-WSCA-15-ACS, executed between Microsoft and the State of Florida.

One Sunshine meeting was held to negotiate this Participating Addendum on August 14, 2017. The meeting was attended by representatives of Microsoft Corporation, the Office of the County Attorney, the Enterprise Technology Services Division and the Purchasing Division.
